Notes on similar group 4405

Official notes (CNIPA Table of Similar Goods and Services, 2026 text; J&C reference translation)

1. This similar group consists of single services, and the paragraphs are not similar to one another;

2. the first paragraph is cross-searched with the accepted service "optometry services" in 4401 in the 12th and earlier editions and with opticians' shops in 4227 in the 7th and earlier editions;

3. optometry services are similar to Part (1) of 4401;

4. rental of sanitary installations is cross-searched with rental of sanitary installations in 4227 in the 7th and earlier editions;

5. rental of eyeglasses and rental of sunglasses are cross-searched with rental of fashion eyeglasses not for vision correction and rental of fashion sunglasses not for vision correction in 4503 in the 12th and earlier editions.

Practice notes (J&C)

This group consists of single services, and the paragraphs are not similar to one another: optician services, optometry services, rental of sanitary installations, provision of service animals for the disabled, rental of eyeglasses and rental of sunglasses. Official notes: optometry services are similar to Part (1) of 4401; new note 5 in 2026 provides that rental of eyeglasses and sunglasses is cross-searched with rental of fashion eyeglasses and sunglasses not for vision correction in 4503 in the 12th and earlier editions.

Changes in 2026: “rental of vision-correction eyeglasses” and “rental of vision-correction sunglasses” were changed to “rental of eyeglasses” and “rental of sunglasses” respectively, the number of “optician services” was changed to C440006, and Class 45's 4503 deleted its fashion-eyewear rental items. Optical shops should file this group together with eyeglass goods in 1011 of Class 10 and retail items in Class 35 (practical tip).
