1. Goods in the different parts of this similar group are not similar to one another;

2. Part (2) is similar to the second paragraph of 2907, cocoa beverages with milk, coffee beverages with milk, chocolate beverages with milk, coffee beverages, cocoa beverages and chocolate beverages in 3001, and 3202, and is cross-searched with chocolate beverages containing milk in 3001 in the 11th and earlier editions and kumis (milk beverage) and kefir (milk beverage) in 2907 and soy milk and fermented mung-bean drink in 3011 in the 10th and earlier editions.

Practice notes (J&C)

This group has two parts, which are not similar to one another: (1) tea, black tea, green tea, oolong tea, jasmine tea, herbal tea, etc.; (2) tea beverages, iced tea (tea beverage), tea beverages with milk. Official note: Part (2) is similar to the second paragraph of 2907, the coffee and cocoa beverages in 3001 and 3202.

In 2026, “iced tea” was changed to “iced tea (tea beverage)”. Tea brands file in Part (1), while milk-tea drink shops should also file in Part (2), 3202 of Class 32 and 4301 of Class 43 (practical tip).
