Practice notes (J&C)

This is one of the groups with the most items and the densest prior trademarks in Class 9; a similarity search must cover all the items in this group. For software, it is advisable to use standardised items (such as “downloadable computer application software” and “recorded computer programs”) and to state the intended use; self-worded “X software” descriptions are often required to be amended (practical tip).

Note the cross-reference with 0908: optical discs and CD-ROMs are similar to CDs (audio-video) and optical discs (audio-video) in 0908, and downloadable music, video and ringtone files are similar to records, audio tapes and video tapes in 0908 (official notes 3 and 4). When applying for data carriers or downloadable content, the prior-trademark search must also cover 0908.

Cross-group protected goods: unfilled toner cartridges and ink cartridges for printers and photocopiers belong to both 0901 and 0903 (official note 2); smartwatches are similar to 1404 (note 6) and styluses for touchscreens are similar to 1614 (note 7), so cover them as needed when selecting items.

Changes in 2026: “near-field communication (NFC) tags” was added; “mice (computer peripherals)” and “trackballs (computer peripherals)” were changed to “computer mice” and “computer trackballs”, and the old wordings are no longer accepted. Software services (design, SaaS, cloud computing) are in Class 42, not in this group; companies that both sell software products and provide services are advised to file in both (practical tip).
