Notes on similar group 0910
Official notes (CNIPA Table of Similar Goods and Services, 2026 text; J&C reference translation)
1. The first paragraph of this similar group is similar to the goods in all its parts;
2. goods in the different parts of this similar group are not similar to one another;
3. Part (1) is cross-searched with gas generators for measurement in Part (3) in the 12th and earlier editions, anemometers in Part (3) in the 11th and earlier editions, and angle-measuring tools and plumb bobs in 0905 in the 10th and earlier editions;
4. in Part (6), similarity between goods is determined according to their function and intended use of the goods;
5. Part (7) is cross-searched with materials testing instruments and machines, testing apparatus not for medical use and diagnostic apparatus not for medical use in Part (3), and with magnetic resonance imaging (MRI) apparatus not for medical use and scanning equipment for automobile diagnostics in Part (6), all in the 12th and earlier editions;
6. humanoid robots with artificial intelligence for scientific research are cross-searched with humanoid robots with artificial intelligence in 0901 in the 11th and earlier editions;
7. electrolysis apparatus for laboratory use is cross-searched with electrolysis apparatus and electrolytic cells in 0915 in the 11th and earlier editions;
8. ozone generators for calibration are cross-searched with ozone generators in Part (3) in the 11th and earlier editions.
Practice notes (J&C)
This group has a first paragraph and seven parts: the first paragraph (general names such as measuring instruments, metering instruments and detectors) is similar to all the parts (note 1), and the parts are not similar to one another (note 2). Part (1) covers general measuring instruments for meteorology, navigation, length, etc.; (2) instruments for vehicles; (3) hydrometers, boiler control instruments, etc.; (4) laboratory apparatus; (5) electrical measuring instruments; (6) scientific apparatus, whose similarity is determined by function and intended use (note 4); (7) testing and diagnostic apparatus not for medical use.
When selecting items, first fix the part: filing only the general names of the first paragraph makes the mark similar to all the parts, giving broad protection but also the greatest chance of a similarity conflict; filing a specific part is judged for similarity only within that part (practical tip).
Changes in 2026: infrared detectors were moved from Part (1) into the first paragraph; laboratory flasks, chemical reactors for laboratory use and gene amplification apparatus for laboratory scientific research were added to Part (4); “inductors (electricity)” was moved from Part (5) into Part (4) of 0913, so sensor products should be filed under the new numbering, with the prior search including the historical records of 0910 in the 12th and earlier editions (note 3 to 0913).
Testing and diagnostic instruments for medical use are in Class 10; Part (7) of this group covers only those not for medical use.
