Which route

Direct filing or a Madrid designation

Both routes lead to protection in Kazakhstan. They differ in prerequisites, whether you must appoint a patent attorney in Kazakhstan first, fee structure and dependency risk. Madrid designations are refused on the same grounds as direct applications, including conflicts with earlier marks.

ItemDirect filing with KazpatentMadrid designation of Kazakhstan
PrerequisiteNoneA basic application or registration at your office of origin
Official feesIn tenge: the examination fees cover 3 classes and 10 items per class, with surcharges beyond that; a registration fee after acceptanceBasic fee paid to the World Intellectual Property Organization (WIPO), plus: if your office of origin is party to both the Madrid Agreement and the Protocol (e.g. China), only the CHF 100 complementary fee for Kazakhstan (and a supplementary fee for more than 3 classes), as Article 9sexies of the Protocol excludes the individual fee; from other offices of origin, Kazakhstan's individual fee (including 3 classes, with a fee for each additional class, in Swiss francs). Dependency riskNoneIf the basic application or registration is refused or cancelled within 5 years, the Kazakh designation falls with it
Best forYou only need Kazakhstan; you have no home filing to rely on; you need flexibility to adjust the goodsYou already have a home filing and want protection in several countries

The treaty on the Eurasian Economic Union trademark (one application covering Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia) entered into force on 26 April 2021, but filing opens only once the member states have completed their preparations and the Eurasian Economic Commission has received the last notification; as of the check date, member states are still discussing common procedures for implementing the system, and EAEU trademark applications cannot yet be filed. Until then, protection in these countries requires a separate application in each, or individual Madrid designations; for Russia, see Trademark registration in Russia.

For a general comparison of the two routes, see Madrid designation or direct national filing: which one fits your case. Not sure? Run a free search first, then submit an order online; the agent will recommend a route based on the search results.

What to prepare

Documents checklist

For a direct application to Kazpatent, applicants based abroad usually prepare the following information and documents.

Applicant

  • Name (for a company, its registered name) and address, with a Russian transliteration for applicants based abroad; the application is completed in Kazakh or Russian, with the attorney handling the translation
  • Country code (WIPO Standard ST.3)

Power of attorney

  • A power of attorney for a patent attorney in Kazakhstan; applications filed through an attorney must include a copy of it
  • Provide the power of attorney and other signed documents as your attorney instructs

The mark

  • A clear, reproducible representation of 8×8 cm; labels can be filed at actual size, up to 20×20 cm
  • File in the colours you want to protect, and name each colour
  • Description of the mark: list its elements and their meaning, and explain how any invented word is formed; three-dimensional, sound and other marks need the materials required for their type

Goods and services

  • Listed item by item under the Nice Classification, in class order and separated by semicolons; avoid vague terms such as "etc." or "other"
  • Each item beyond 10 in a class adds to the examination fees; if the fees paid do not match the number of items listed, examination of the application is terminated

Priority and consent (if any)

  • Earlier application filed abroad: priority can be claimed within 6 months; declare it at filing or within 2 months after, and file a certified copy of the earlier application
  • Letter of consent from the owner of an earlier mark: a legal entity issues it on company letterhead, signed by an authorised person and stamped (if it has a seal); an individual's consent must be notarised; one letter per application, and a consent in another language needs a Kazakh or Russian translation within 1 month

Applications can be filed on paper, or electronically with a digital signature through a personal account on Kazpatent's website or the e-government portal; for applicants based abroad, the attorney files on their behalf.

How long

Process and timeline

Example: a direct application under the ordinary procedure, with no refusal or opposition.

  1. Step 1

    Clearance search (recommended)

Search for identical and similar marks, check what the mark means in Kazakh and Russian, and settle the classes and wording

  2. Step 2

    Filing and examination fees

Pay the formal and substantive examination fees with the application; the amounts must match the number of classes and items

  3. Step 3

    Formal examination

Completed within 1 month of filing (statutory); if the application is in order, you receive an acknowledgement

  4. Step 4

    Publication and opposition

Published within 5 working days of completing formal examination (statutory); the opposition period runs for 2 months from publication (statutory)

  5. Step 5

    Substantive examination

Completed within 7 months of filing (statutory); if a refusal is proposed, you can submit written arguments within 3 months (statutory)

  6. Step 6

    Acceptance and registration fee

Pay the registration fee within 3 months of the acceptance notice (statutory), or the application is deemed withdrawn

  7. Step 7

    Registration and certificate

Entered in the register and an electronic certificate issued within 10 working days of payment (statutory service period), then published in the official bulletin

Kazpatent does not publish average times from filing to registration; the periods above are the maximums set by law and regulations. If the office asks for further documents, you have 3 months to reply and examination is suspended meanwhile; if you disagree with a final refusal, you can request a review by the Ministry of Justice's Appeals Board within 3 months (statutory), which makes the process considerably longer.

Expedited examination can be requested at filing or within 5 months of the filing date. If requested with the application, formal examination takes 10 working days and substantive examination is completed within 3 months of filing; under the expedited procedure, an application is deemed withdrawn if a deadline is missed, and it cannot be restored.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

How much

Official fees

Official fees follow the statutory price list of the National Institute of Intellectual Property, charged in tenge and including 16% VAT, and are paid in two stages: at filing, the formal examination fee and the substantive examination fee, each covering 3 classes and 10 items per class, with surcharges for each class from the 4th and for each item beyond 10 in a class; after acceptance, the registration fee, which also covers 3 classes. Prices come in three tiers (legal entities, small and medium-sized enterprises of Kazakhstan, and individuals); the table below shows the rates for legal entities, in force since 1 January 2026.

Source: kazpatent.kz · current fees in force since 2026-01-01 · checked on 2026-10-10 · USD figures are approximate, converted at the Bank of China spot selling rate (or, for currencies it does not quote, at the central bank's published USD rate); the official fee is the amount in the original currency

Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: an application covering 3 classes with no more than 10 items in each pays at filing 31,718.75 + 86,093.75 = KZT 117,812.50; after acceptance, the KZT 37,849.64 registration fee: KZT 155,662.14 in official fees in total.

With 4 classes, add 14,821.06 + 20,173.13 at filing, KZT 152,806.69 in all, and KZT 11,185.72 to the registration fee; if one class lists 12 items, add a further 2 × (700 + 1,250) = KZT 3,900.

Expedited examination costs KZT 797,500 for up to 3 classes (instead of the ordinary examination fees), with extra classes and items charged on top.

Amounts converted into other currencies depend on the tenge exchange rate on the day of payment. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

Watch out

Rules specific to Kazakhstan and common refusals

These are the most common issues in Kazakh examination, along with Kazakhstan-specific rules that are easy to overlook.

Opposition comes early: only 2 months after publication

A rule particular to Kazakhstan: applications are published within 5 working days of completing formal examination, well before substantive examination. Any interested party can oppose with Kazpatent within 2 months of publication, on absolute grounds or earlier rights, and the applicant has 3 months to reply in writing once notified. Earlier right holders should watch the weekly official bulletin: once this window has passed, the only option is to seek invalidation before the Appeals Board after registration.

Consent overcomes similarity, not identity

If a mark is similar to an earlier registration, an earlier application or a well-known mark, the earlier owner's written consent allows registration; if it is identical to the earlier mark, consent is not accepted. A separate letter of consent is needed for each application; a legal entity issues it on letterhead, signed and stamped, and an individual's consent must be notarised.

Fees assume 3 classes and 10 items per class: keep the list lean

Since 1 January 2026, both formal and substantive examination fees are charged for each item beyond 10 in a class. Kazpatent requires items to be separated by semicolons, and if the fees paid do not match the number of items, you are notified that examination is terminated. Copying a long list from your home filing pushes up official fees and adds the risk of termination.

Descriptive and generic terms

Signs that directly describe the kind, quality, purpose or origin of the goods, or that have become generic, cannot be registered; they can appear in a mark as unprotected elements but must not dominate it, unless distinctiveness has been acquired through use. Foreign-language marks are assessed with their meaning in Kazakh and Russian in mind.

Revocation after 3 years of non-use

Owners must use their marks. Any interested party can sue in court to revoke the registration for all or some of the goods on the ground of 3 consecutive years of non-use before the claim; use by a licensee, display at exhibitions, advertising and use in a website domain name all count as evidence of use, and non-use for reasons beyond the owner's control can be justified.

Filings by agents and distributors

If an agent or representative registers, without authorisation and in its own name, the mark of a right holder from a Paris Convention country, the right holder can seek invalidation before the Ministry of Justice's Appeals Board throughout the term of the registration; invalidation based on a conflict with an earlier mark must be sought within 5 years of registration.

After registration

Keeping the registration

A Kazakh registration needs no periodic declarations of use, but non-use can lead to revocation in court, and the registration ends if the renewal restoration period is missed.

For 1 year after a registration lapses, no one else can register an identical or similar mark, so the former owner still has a chance to file again.

Chapter 52 of the Customs Code of the Eurasian Economic Union provides customs measures to protect IP rights, including suspending the release of suspected infringing goods; once registered, you can apply as your attorney advises. E-commerce brand registries usually also require a registered or pending trademark.

FAQ

Trademark registration in Kazakhstan

How much does a Kazakhstan trademark cost?

At the rates for legal entities in force since 1 January 2026 (including 16% VAT): at filing, a KZT 31,718.75 formal examination fee and a KZT 86,093.75 substantive examination fee, each covering 3 classes and 10 items per class; after acceptance, a KZT 37,849.64 registration fee (up to 3 classes). For 3 classes with no more than 10 items each, official fees total KZT 155,662.14. Classes from the 4th and items beyond 10 in a class are charged extra. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

How long does trademark registration in Kazakhstan take?

The statutory periods are: formal examination within 1 month of filing and substantive examination within 7 months of filing; payment of the registration fee within 3 months of acceptance; registration within 10 working days of payment. Kazpatent does not publish average times. With expedited examination, substantive examination can be completed within 3 months of filing. A refusal, a request for further documents or an opposition makes the process longer.

Can a foreign company file directly with Kazpatent?

No. Individuals domiciled outside Kazakhstan and foreign legal entities must act through a patent attorney in Kazakhstan. If you designate Kazakhstan through the Madrid System, you need no local attorney to file, but you must appoint one to answer a refusal notice or request a review.

Can I file a Eurasian Economic Union trademark now?

Not yet. The Treaty on EAEU trademarks entered into force on 26 April 2021, but filing opens only once the member states have completed their preparations and the Eurasian Economic Commission has received the last notification; as of the check date, this has not happened. For now, protection in Kazakhstan, Russia and the other member states requires a separate application in each, or individual Madrid designations; for the rules in Russia, see Trademark registration in Russia.

Is there an opposition period in Kazakhstan?

Yes. The application is published in the official bulletin once formal examination is complete, and any interested party can file an opposition with Kazpatent within 2 months of publication (extended from 1 month on 25 January 2026); the applicant has 3 months to reply. After registration, an opposition can also be filed with the Ministry of Justice's Appeals Board to invalidate the registration.

What happens if a registered mark is not used in Kazakhstan?

After 3 consecutive years of non-use, any interested party can sue in court to revoke the registration for all or some of the goods. Keep dated evidence of use in Kazakhstan, such as sales contracts, invoices, customs declarations, advertising and web pages.

Other IP rights
