Key facts

Trademarks in Armenia: key facts

OfficeThe Intellectual Property Office (Մտավոր սեփականության գրասենյակ, under the Ministry of Economy of the Republic of Armenia; renamed from the Intellectual Property Agency on 26 July 2021) is the state authorised body under the Trademark Law: it receives, examines and registers applications and issues certificates; appeals against refusals are heard by the Board of Appeals at the Office. Website and search links: IP Toolbox.
LawLaw on Trademarks (No. ՀՕ-59-Ն of 29 April 2010, in force since 1 July 2010; the current text includes the amendments made by Law No. ՀՕ-143-Ն of 13 April 2023 and Law No. ՀՕ-427-Ն of 4 December 2025); filing and examination procedure in Government Decision No. 1538-Ն of 2010; official fees under Article 18(4) of the Law on State Duty
Madrid SystemParty to the Madrid Agreement since 25 December 1991 and the Madrid Protocol since 19 October 2000, so Armenia can be designated through Madrid; Armenia has declared an 18-month refusal period and an individual fee, but under Article 9sexies of the Protocol neither declaration applies to designations from an office of origin bound by both treaties, such as China: those designations pay only the CHF 100 complementary fee (plus a supplementary fee for more than 3 classes) and the refusal period is 12 months
Eurasian Economic Union trademarkArmenia is a member of the Eurasian Economic Union; the Treaty on Trademarks of the Eurasian Economic Union entered into force on 26 April 2021 and Armenia has written the EAEU trademark fees into the Law on State Duty, but as of the check date no official announcement that any member state's office has started accepting EAEU trademark applications could be found
Foreign applicantsIndividuals without permanent residence in Armenia and foreign legal entities without a real establishment there must file and conduct examination proceedings through an Armenian trademark attorney, or through another representative registered and permanently resident in Armenia with a place of business there; the power of attorney can be filed with the application or within 2 months after filing
LanguageThe application is completed in Armenian; attachments may be in another language, and applicants abroad file the Armenian translation within 2 months of filing; foreign-language elements of the mark must be given with a transliteration and an Armenian translation
Classes and fee basisOne application covers one mark and can include several Nice classes; the filing fee of AMD 30,000 is charged per application, the examination fee of AMD 40,000 covers 1 class and each additional class adds AMD 15,000; the registration fee of AMD 50,000 is charged per application with no surcharge per class
Examination time (statutory)Preliminary examination within 10 working days of the filing date being established; publication within 15 working days of the decision to publish; substantive examination within 3 months of publication (suspended while observations or an opposition are pending); the law provides no expedited examination
Opposition (statutory)Within 2 months of publication, anyone can file written observations on absolute grounds, and owners of earlier marks or other earlier rights and any interested person can oppose on relative grounds (fee AMD 10,000); the applicant replies within 1 month of notification
Term and renewal10 years from the filing date; renewable for 10 years each time without limit; renew in the last year of the term, or within 6 months after expiry for an additional fee; the Office notifies the owner in the ninth month of the last year
Non-use (statutory)If the mark has not been genuinely used in Armenia for 3 consecutive years from registration, or for the 3 years before the action, any interested person can ask a court to revoke the registration for all or some of the goods (5 years before the 2023 amendment); the burden of proving use lies with the owner
Fee discountsArticle 28 of the Law on State Duty: individuals and legal entities with no more than 25 employees pay 25% (a 75% reduction), legal entities with 25 to 100 employees pay 50%; the law does not distinguish between residents and non-residents, but proof of the number of employees on the payment date must be filed with the application. The examples on this page use the full rate
Official fees (full rate)One class: filing fee AMD 30,000 + examination fee AMD 40,000 = AMD 70,000, paid with the application; after approval, registration fee AMD 50,000; each additional class adds AMD 15,000 to the examination fee (Article 18(4) of the Law on State Duty, in multiples of the AMD 1,000 base duty)

Which route

Direct filing or a Madrid designation

Both routes lead to protection in Armenia. They differ in prerequisites, whether you must appoint an Armenian representative first, fee structure and dependency risk. The Intellectual Property Office examines Madrid designations on the same absolute and relative grounds as direct applications, and third parties can file observations or oppose in the same way.

ItemDirect filing with the Intellectual Property OfficeMadrid designation of Armenia
PrerequisiteNoneA basic application or registration at your office of origin
Official feesIn Armenian drams (AMD), paid in two stages: at filing, the filing fee and the examination fee (covering 1 class, with a surcharge per additional class); after approval, the registration feeBasic fee paid to the World Intellectual Property Organization (WIPO), plus: if your office of origin is bound by both the Madrid Agreement and the Protocol (e.g. China), only the CHF 100 complementary fee for Armenia (and a supplementary fee for more than 3 classes), as Article 9sexies of the Protocol excludes the individual fee; from other offices of origin, Armenia's individual fee (one amount for the first class, plus a fee for each further class). See the WIPO fee calculator
Armenian representativeRequired from filing for applicants based abroad: an Armenian trademark attorney or a locally registered representativeNot needed to file; once the Office issues a provisional refusal, correspondence with the holder goes through a local representative
Examination timeStatutory: preliminary examination 10 working days, substantive examination within 3 months of publication, no fast trackFor designations from an office of origin bound by both treaties (e.g. China), the Office must notify a provisional refusal within 12 months (Armenia's declared 18 months does not apply between such parties); 18 months from other offices of origin. Third parties can file observations or oppose within 6 months of publication by the International Bureau
Wording of goods and servicesListed item by item under the Nice Classification in ascending class order; foreign-language marks need a transliteration and an Armenian translationCannot go beyond the basic application or registration
Dependency riskNoneIf the basic application or registration is refused or cancelled within 5 years, the Armenian designation falls with it
Best forYou only need Armenia; you have no home filing to rely on; you need flexibility to adjust the goodsYou already have a home filing and want protection in several countries

The treaty on the Eurasian Economic Union trademark (one application covering Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia) entered into force on 26 April 2021, but filing opens only once each member state has completed its preparations and the Eurasian Economic Commission has received the last notification. Armenia has written the EAEU trademark filing, examination and registration fees into the Law on State Duty, yet as of the check date the member states were still discussing the common procedures for the system, and no official announcement that any member state's office has started accepting applications could be found. Until then, protection in these countries requires a separate application in each, or individual Madrid designations; for Russia, see Trademark registration in Russia.

For a general comparison of the two routes, see Madrid designation or direct national filing: which one fits your case. Not sure? Run a free search first, then submit an order online; the agent will recommend a route based on the search results.

What to prepare

Documents checklist

For a direct application to the Intellectual Property Office, applicants based abroad usually prepare the following information and documents.

Applicant

  • Name (for a company, its registered name) and address; the application is completed in Armenian, with the representative handling the translation
  • If you claim a fee discount, attach proof of the number of employees on the payment date (not needed at the full rate)

Power of attorney

  • A power of attorney for an Armenian trademark attorney or a locally registered representative; it can be filed with the application or within 2 months after filing; if it is late, the Office allows a further 2 months, after which the application is deemed withdrawn
  • Provide the power of attorney and other signed documents as your representative instructs

The mark

  • A clear, reproducible representation of the mark and its description; sound marks are filed as musical notation, and three-dimensional or hologram marks are identified as such on the form
  • Marks in a language other than Armenian (including non-Latin scripts) must be given with a transliteration and an Armenian translation; elements you do not claim can be disclaimed on the form
  • If a combination of colours is claimed as a distinctive feature, state it on the form

Goods and services

  • Listed item by item under the edition of the Nice Classification in force on the filing date and grouped in ascending class order; the examination fee covers 1 class, and each additional class adds AMD 15,000

Priority and consent (if any)

  • Earlier application filed abroad: priority can be claimed within 6 months; declare it at filing or within 2 months after, and within 3 months of filing submit a copy of the earlier application certified by the office of first filing, with an Armenian translation, plus AMD 10,000 per priority claim
  • If the mark conflicts with an earlier mark or other earlier right, a letter of consent from the earlier right holder can be filed with the application; consent is not accepted for an identical mark covering goods of the same kind

Applications can be filed on paper or through the Office's electronic filing system; for applicants based abroad, the representative files on their behalf. The filing date is the date on which the indication of the mark, the applicant's details, contact details, the representation, the list of goods and proof of payment are all in; if something is missing, the Office notifies you within 4 working days and you have 2 months to complete it.

How long

Process and timeline

Example: a direct application with no refusal and no opposition.

  1. Step 1

    Clearance search (recommended)

Search for identical and similar marks, check what the mark means in Armenian and Russian, and settle the classes and wording

  2. Step 2

Filing, with the filing and examination fees

The filing fee and the examination fee are paid together with the application; proof of payment is one of the requirements for a filing date (statutory); the power of attorney can follow within 2 months

  3. Step 3

    Preliminary examination

Completed within 10 working days of the filing date being established (statutory); deficiencies are corrected within 2 months; if all is in order, the Office decides to publish and to proceed to substantive examination

  4. Step 4

    Publication and opposition

Published in the official bulletin "Industrial Property" within 15 working days of the decision (statutory); observations and oppositions can be filed within 2 months of publication (statutory), and the applicant replies within 1 month of notification

  5. Step 5

    Substantive examination

Completed within 3 months of publication (statutory), suspended while observations or an opposition are pending; if refusal is intended, the applicant has 2 months from notification to withdraw, amend or respond (statutory)

  6. Step 6

    Approval and registration fee

Pay the registration fee and file proof of payment within 3 months of receiving the approval notice (statutory); otherwise the application is deemed withdrawn

  7. Step 7

    Registration, certificate and publication

Entered in the register within 10 working days of receipt of proof of payment (statutory), published in the official bulletin within 1 month of registration, and the certificate is issued

The Office publishes no average time from filing to registration; the periods above are the statutory maximums. Adding them up, an application with no observations, opposition or refusal can be registered in about six months (estimate). If the application is refused, you can request re-examination within 2 months of receiving the decision, and the Office decides within 2 months; a re-examination decision can be appealed to the Board of Appeals within 3 months (fee AMD 50,000), and the Board's decision can be challenged in court within 2 months. This makes the process considerably longer.

The law provides no expedited examination, and the Office states in its FAQ that no fast-track registration is available; if you need protection early, the only option is to file early. A missed procedural deadline can be restored within 2 months after it expires, and an extension of up to 6 months can be requested before it expires, both for a fee.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

How much

Official fees

Armenian trademark fees are state duties set in Article 18(4) of the Law on State Duty, calculated as multiples of the AMD 1,000 base duty; the fee schedule published by the Intellectual Property Office matches the law. Fees are paid in two stages: at filing, the filing fee (per application) together with the examination fee (covering 1 class, with a surcharge per additional class); after approval, the registration fee (per application, with no surcharge per class). Individuals and legal entities with no more than 25 employees get a 75% reduction and legal entities with 25 to 100 employees a 50% reduction; the law does not distinguish between residents and non-residents, but proof of the number of employees is required. Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: an application covering 1 class pays at filing the AMD 30,000 filing fee + the AMD 40,000 examination fee = AMD 70,000; after approval, the AMD 50,000 registration fee, bringing official fees to AMD 120,000 in total.

With 3 classes, the examination fee is 40,000 + 2×15,000 = AMD 70,000, so AMD 100,000 is paid at filing; the registration fee does not depend on the number of classes and stays at AMD 50,000, so official fees total AMD 150,000. One priority claim adds AMD 10,000.

If you qualify for a discount and file proof of the number of employees, the amounts above are charged at 25% or 50%; whether an applicant abroad can obtain the discount with proof issued in its home country should be confirmed with the agent when you place the order.

The exchange rate between the dram and your currency is the rate on the day of payment. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

Watch out

Rules specific to Armenia and common refusals

These are the most common issues in Armenian examination, along with Armenia-specific rules that are easy to overlook.

Opposition comes early: only 2 months after publication

A feature of Armenia: an application is published within 15 working days of passing preliminary examination, before substantive examination. Within 2 months of publication, anyone can file written observations on absolute grounds, and owners of earlier marks or other earlier rights and any interested person can oppose on relative grounds; the applicant replies within 1 month of notification. This period can be neither extended nor restored. Earlier right holders need to watch the "Industrial Property" bulletin; if they miss it, the only remedy is a court action for invalidity after registration, and on relative grounds that action must be brought within 5 years of publication of the registration.

Filing a mark you know someone else is using is refused as bad faith

Article 10(4) of the Trademark Law: if, on the filing date, a mark is still in use in Armenia or abroad and the applicant knew or should have known of it when filing an identical or confusingly similar mark, the application is deemed to be made in bad faith and refused; filing false documents also counts as bad faith. If an agent or representative files in its own name without authorisation, the owner of a mark protected in a country party to the Paris Convention or the WTO can oppose, seek cancellation or demand that the registration be transferred. For brands used abroad, this is the basis for acting against squatters, and a risk for anyone filing a mark that imitates a foreign brand.

Consent overcomes a conflict, except for an identical mark on goods of the same kind

A mark that conflicts with an earlier mark or other earlier right can be registered with the written consent of the earlier right holder, its successor or the competent authority; but consent is not accepted where an identical mark is filed for goods or services of the same kind. If an invalidity action is brought after registration, consent obtained before the action is equally effective.

A registration that lapsed for non-renewal in the last 2 years still blocks a new filing

An application for a mark identical or similar to an earlier registered mark, for identical goods or goods of the same kind, is refused if that registration lapsed for non-renewal within the 2 years before the filing date, unless the former owner consents or has stopped using the mark. When searching, do not look only at registrations in force: check registrations that lapsed in the last two years as well.

3 years of non-use allow a court action for revocation, and the owner carries the burden of proof

If the mark has not been genuinely used in Armenia for 3 consecutive years from registration, or for the 3 years before the action, any interested person can ask a court to revoke the registration for all or some of the goods; use started or resumed within the 3 months before the action does not count if it began after the owner learnt that an action might be brought. The burden of proof lies with the owner; use by a licensee counts, as does affixing the mark in Armenia solely for export. Before the 2023 amendment this period was 5 years.

Descriptive signs and the meaning of foreign words

Signs consisting solely of indications of the kind, quality, quantity, purpose, value or origin of the goods, signs that have become generic, and signs that would mislead consumers are refused on absolute grounds. If the mark contains an element that cannot be registered on its own, the Office asks you to disclaim exclusive rights in it within 2 months; no reply is treated as agreement. Foreign-language marks are assessed together with their transliteration and Armenian translation, so check the meaning before filing.

After registration

Keeping the registration

An Armenian registration needs no periodic declarations of use, but non-use can lead to a court action for revocation, and the registration ends if the renewal grace period is missed.

An invalidity action on relative grounds must be brought in court within 5 years of publication of the registration; an earlier right holder who has knowingly tolerated use for 5 consecutive years can no longer seek invalidity or an injunction (except against a registration made in bad faith). E-commerce brand registries usually also require a registered or pending trademark.

FAQ

Trademark registration in Armenia

How much does an Armenia trademark cost?

At the full rate under the Law on State Duty: at filing, the AMD 30,000 filing fee and the AMD 40,000 examination fee (covering 1 class, plus AMD 15,000 per additional class); after approval, the AMD 50,000 registration fee, with no surcharge per class. For example, official fees total AMD 120,000 for 1 class and AMD 150,000 for 3 classes. Individuals and legal entities with no more than 25 employees get a 75% reduction and those with 25 to 100 employees a 50% reduction, on proof of the number of employees. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

How long does trademark registration in Armenia take?

The statutory milestones are: preliminary examination within 10 working days of the filing date being established, publication within 15 working days of the decision, a 2-month opposition period after publication, substantive examination within 3 months of publication, payment of the registration fee within 3 months of approval, and registration within 10 working days of payment. The Office publishes no average time and has no expedited procedure; adding up the statutory periods, a smooth application can be registered in about six months (estimate). Observations, an opposition, a refusal or re-examination make the process longer.

Can a foreign company file directly with the Intellectual Property Office?

No. Individuals without permanent residence in Armenia and foreign legal entities without a real establishment there must file and conduct examination proceedings through an Armenian trademark attorney, or through another representative registered and permanently resident in Armenia with a place of business there. If you designate Armenia through the Madrid System, you need no local representative to file, but once the Office issues a provisional refusal, the subsequent proceedings go through a local representative.

Can I file a Eurasian Economic Union trademark now?

Not yet. The Treaty on Trademarks of the Eurasian Economic Union entered into force on 26 April 2021, and Armenia has written the EAEU trademark fees into the Law on State Duty, but filing opens only once all member states have completed their preparations and notified the Eurasian Economic Commission; as of the check date, no official announcement that any member state's office has started accepting applications could be found. For now, protection in Armenia, Russia and the other member states requires a separate application in each, or individual Madrid designations; for the rules in Russia, see Trademark registration in Russia.

Is there an opposition period in Armenia?

Yes. Once an application passes preliminary examination, it is published in the official bulletin "Industrial Property"; within 2 months of publication, anyone can file written observations on absolute grounds, and owners of earlier marks or other earlier rights and any interested person can oppose on relative grounds, for an opposition fee of AMD 10,000; the applicant replies within 1 month of notification. A party dissatisfied with the outcome can bring an invalidity action in court after registration.

What happens if a registered mark is not used in Armenia?

If the mark has not been genuinely used in Armenia for 3 consecutive years from registration, or for the 3 years before the action, any interested person can ask a court to revoke the registration for all or some of the goods, and the burden of proving use lies with the owner. Keep dated evidence of use in Armenia, such as sales contracts, invoices, customs declarations, advertising and web pages; affixing the mark in Armenia solely for export also counts as use.

Other IP rights

Patents: under the Armenian Patent Law (in force since 1 July 2021), an invention patent lasts 20 years from the filing date, and there is also a 10-year short-term invention patent. PCT applications can enter the Armenian national phase (the PCT has applied to Armenia since 25 December 1991), and a Eurasian patent from the Eurasian Patent Office also takes effect in Armenia (Armenia has been party to the Eurasian Patent Convention since 27 February 1996).

Industrial designs: under the Industrial Design Law (in force since 1 July 2021), a registered design is protected for 5 years from the filing date, renewable for 5-year periods up to a maximum of 25 years; besides a direct application to the Intellectual Property Office, Armenia can be designated through the Hague System (since 13 July 2007).
