Trademark registration in Azerbaijan

To register a trademark in Azerbaijan, file with the Intellectual Property Agency of the Republic of Azerbaijan or designate Azerbaijan through the Madrid System. Direct filings from abroad need an Azerbaijani patent attorney. There is no pre-registration opposition: the examiner checks earlier marks, and after acceptance you have 4 months to pay the registration fee.

LawLaw on Trademarks and Geographical Indications (Law No. 504-IQ of 1998; the current text includes the amendments made by Law No. 161-VIIQD of 18 March 2025); filing and examination rules in Cabinet of Ministers Resolution No. 166 of 1999, as amended
Madrid SystemParty to the Madrid Agreement (since 25 December 1995) and the Madrid Protocol (since 15 April 2007), so Azerbaijan can be designated through Madrid; Azerbaijan has not declared an 18-month refusal period and charges no individual fee
Regional systemsAzerbaijan is a member of the Eurasian Patent Organization (since 25 December 1995), but Eurasian patents cover inventions only; Azerbaijan is not a member of the Eurasian Economic Union, so the EAEU trademark does not concern Azerbaijan
Foreign applicantsForeign legal entities and individuals with no business activity in Azerbaijan can deal with the Agency on trademark matters only through a patent attorney registered with the Agency
LanguageThe application form is in Azerbaijani; other documents may be in a foreign language, with an Azerbaijani translation filed within 2 months, extendable by a further 2 months for a fee; the mark or its elements must come with a transliteration and translation
Classes and fee basisOne application covers one mark and can include several classes; the substantive examination fee covers the 1st class, with a surcharge for each class from the 2nd
Examination time (statutory)Formal examination within 1 month of receipt; substantive examination within 6 months after formal examination ends; on request and for a fee, examination is completed within 1 month

Letter of consentIf the mark is refused as similar to an earlier registration or application, a letter of consent from the earlier owner can be taken into account both during examination and before the Appeals Board
Registration fee (statutory deadline)Pay within 4 months of receiving the acceptance decision, extendable by a further 4 months for a fee; if still unpaid, the decision lapses and the application is deemed withdrawn

Which route

Direct filing or a Madrid designation

Both routes lead to protection in Azerbaijan. They differ in prerequisites, whether you must appoint an Azerbaijani patent attorney first, fee structure and dependency risk. The Agency examines Madrid designations against the same standards as direct applications.

ItemDirect filing with the Intellectual Property AgencyMadrid designation of Azerbaijan
PrerequisiteNoneA basic application or registration at your office of origin
Official feesIn manat: the examination fees cover the 1st class, with a surcharge for each class from the 2nd; a registration fee after acceptanceBasic fee paid to the World Intellectual Property Organization (WIPO), plus the complementary and supplementary fees for designating Azerbaijan (Azerbaijan charges no individual fee); see the WIPO fee calculator
Azerbaijani patent attorneyRequired from filing for applicants based abroadNot needed to file; required to answer a provisional refusal, to deal with the Agency or to request a review by the Appeals Board
Examination timeStatutory: formal examination within 1 month, substantive examination within 6 months after that, or 1 month with paid expedited examinationExamined within the 12-month refusal period under the Madrid Protocol; the result is notified through WIPO
Wording of goods and servicesListed item by item in Azerbaijani under the Nice Classification; class numbers or class headings alone are not acceptedCannot go beyond the basic application or registration
Dependency riskNoneIf the basic application or registration is refused or cancelled within 5 years, the Azerbaijani designation falls with it
Best forYou only need Azerbaijan; you have no home filing to rely on; you need flexibility to adjust the goodsYou already have a home filing and want protection in several countries

Azerbaijan is not a member of the Eurasian Economic Union, so the EAEU trademark being prepared will not cover Azerbaijan. If you also need Russia, Kazakhstan or other countries in the region, you still file in each country or designate them one by one through Madrid; see Trademark registration in Russia and Trademark registration in Kazakhstan.

For a general comparison of the two routes, see Madrid designation or direct national filing: which one fits your case. Not sure? Run a free search first, then submit an order online; the agent will recommend a route based on the search results.

What to prepare

Documents checklist

For a direct application to the Intellectual Property Agency, applicants based abroad usually prepare the following information and documents.

Applicant

  • Name (for a company, the name on its registration documents, with an English version) and address; individual applicants also give their full name
  • The application form is completed in Azerbaijani, translated and signed by the patent attorney

Power of attorney

  • Power of attorney for an Azerbaijani patent attorney, in simple written form; the Agency's rules expressly state that no notarisation is required, and applicants abroad draw it up in the form prescribed by their own law
  • Valid for up to 3 years; if no term is stated, 1 year from the date of signature; it can cover one or several applications

Mark

  • Word mark: the wording; figurative or combined mark: a clear representation; three-dimensional mark: a representation of its three-dimensional form
  • Filed in the colours claimed, with each colour named
  • The mark, or any foreign-language element of it, must come with a transliteration and translation; unusual scripts or lettering also need an explanation of their meaning or origin

Goods or services

  • Listed item by item under the Nice Classification, grouped by class number, in Azerbaijani
  • If you give only class numbers or class headings, or write that the list will follow later, the application is returned and treated as not filed

Priority and letter of consent (if any)

  • Earlier application filed abroad: priority can be claimed within 6 months; declare it at filing or within 3 months afterwards, and file a certified copy of the earlier application within 3 months
  • If the owner of an earlier mark agrees to the registration, file the letter of consent; it can be considered during examination and on review

Applications can be filed with the Agency directly or online through the government e-services portal; applicants abroad file through their patent attorney.

How long

Process and timeline

Example: a direct application under the ordinary procedure, with no refusal.

  1. Step 1

    Clearance search (recommended)

Search the Agency's register for identical and similar marks, check what the mark means in Azerbaijani, and settle the classes and wording

  2. Step 2

    Filing and examination fees

Pay the formal and substantive examination fees with the application; translations of foreign-language documents can follow within 2 months (statutory)

  3. Step 3

    Formal examination

Completed within 1 month of receipt (statutory); the outcome is acceptance for examination or refusal to accept

  4. Step 4

    Substantive examination

Completed within 6 months after formal examination ends (statutory); if a refusal is proposed, you first receive a notice and can submit arguments within 2 months (statutory); requests for further documents must be answered within 2 months, extendable by 2 months, or the application is deemed not filed (statutory)

  5. Step 5

    Acceptance and registration fee

Pay the registration fee within 4 months of receiving the acceptance decision (statutory), extendable by a further 4 months for a fee

  6. Step 6

    Registration, publication and certificate

Entered in the register within 1 month of payment (statutory), certificate issued within 1 month of registration (statutory), and the registration published in the official bulletin

The Agency does not publish average times from filing to registration; the periods above are the maximums set by law. If you disagree with a refusal, you can pay the fee and request a review by the Appeals Board within 3 months of receiving the decision; the Board decides within 3 months, and its decision can be challenged in court within 3 months.

You can request expedited examination: substantive examination is then completed within 1 month, for a surcharge of AZN 180.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

How much

Official fees

Azerbaijani official fees come in two parts: examination, priority, extensions, renewal and licence recordal are paid under the Agency's service price list approved by the Cabinet of Ministers (Resolution No. 247 of 2019, as amended by Resolution No. 198 of 19 May 2022); registration and certificate, changes to the register, recordal of assignments and requests to the Appeals Board are paid under the State Duty Law. Both are charged in manat, with no distinction between residents and non-residents or between companies and individuals. The examination fees cover the 1st class, with a surcharge for each class from the 2nd; the registration fee is charged per application.

Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: an application covering 1 class pays at filing the formal examination fee 60 + substantive examination fee 203 = AZN 263; after acceptance, the AZN 45 registration fee: AZN 308 in official fees in total.

With 3 classes, 263 + 2 × 60 = AZN 383 at filing, plus the AZN 45 registration fee, AZN 428 in all. Claiming priority costs a further AZN 23; expedited examination within 1 month costs AZN 180.

If you miss the 4-month deadline for the registration fee and request a further 4 months, add AZN 45.

Amounts converted into other currencies depend on the manat exchange rate on the day of payment. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

Watch out

Rules specific to Azerbaijan and common refusals

These are the most common problems in Azerbaijani examination, and rules specific to Azerbaijan that are easy to overlook.

No pre-registration opposition, so watch the registration bulletin

The Law on Trademarks and Geographical Indications provides no pre-registration opposition and applications are not published, so earlier right holders have no statutory way to intervene during examination. After the registration notice, invalidation requests on relative grounds (earlier registration or application, well-known mark, trade name) must be filed with the Appeals Board within 5 years of the publication date; on absolute grounds, such as lack of distinctiveness, they can be filed at any time during the term. Once your mark is registered in Azerbaijan, keep checking the bulletin and the register and act promptly against similar marks.

Earlier marks are refused ex officio; a letter of consent can help

The examiner searches for earlier registrations and applications covering identical or similar goods, as well as well-known marks and trade names protected in Azerbaijan, and refuses similar marks without waiting for the other side to object. Before the refusal you receive a notice and can submit arguments within 2 months; a letter of consent from the earlier owner can be taken into account during examination and before the Appeals Board.

The list of goods must be written item by item in Azerbaijani

The Agency's examination centre expressly warns that an application whose list is in a foreign language, gives only class headings or class numbers, or says the list will follow later is returned and treated as not filed, so the filing date is lost. Submitting your home-country list in its original language is the most common mistake; have the patent attorney translate it item by item into Azerbaijani under the Nice Classification and check the wording before filing.

No payment within 4 months of acceptance, and the application lapses

After the acceptance decision, you must pay the AZN 45 registration fee within 4 months before registration, publication and the certificate go ahead. If you miss it, the only option is to pay a further AZN 45 for a 4-month extension; if the fee is still unpaid, the decision lapses and the application is deemed withdrawn, leaving you to file again. Madrid designations have no such step.

5 years of non-use allows revocation, and the burden of proof is on you

If the mark is not used for 5 consecutive years from the registration date, or during the 5 years before a revocation request, anyone can pay the fee and ask the Appeals Board to revoke the registration; the Board decides within 3 months. The law places the burden of proving use on the owner, and only circumstances beyond the owner's control, such as import restrictions, count as a defence. Use on goods, packaging, advertising, at trade fairs and in sales documents all counts.

Registration by an agent or distributor

If an agent or representative registers, without authorisation and in its own name, the mark of a right holder from a Paris Convention country, the right holder can seek invalidation of that registration and prohibit its use in Azerbaijan. Filing in your own name before entering the Azerbaijani market is faster and cheaper than recovering the mark afterwards.

After registration

Keeping the registration

An Azerbaijani registration needs no periodic declarations of use, but non-use can lead to revocation, and the registration lapses if the renewal grace period is missed.

The ® symbol may be used only once the mark is registered in Azerbaijan; the Agency's examination centre specifically warns about this.

Under Article 34 of the Law on Trademarks and Geographical Indications, the right holder can ask customs to suspend the release of suspected infringing imports or exports; where a court so orders, imported goods are held for 10 working days. Follow the agent's instructions for the application. Brand registries on e-commerce platforms usually also require a registered or pending mark.

FAQ

Trademark registration in Azerbaijan

How much does trademark registration in Azerbaijan cost?

Under the Agency's service price list as amended on 19 May 2022 and the State Duty Law: at filing, the formal examination fee of AZN 60 and the substantive examination fee of AZN 203 (covering 1 class, plus AZN 60 for each class from the 2nd); after acceptance, the registration fee of AZN 45. For example, 1 class costs AZN 308 in official fees in total and 3 classes AZN 428. Claiming priority costs a further AZN 23. Service fees are quoted by the agent after you submit the order.

How long does trademark registration in Azerbaijan take?

The statutory periods are: formal examination within 1 month of receipt and substantive examination within 6 months after formal examination ends; after acceptance, the registration fee is paid within 4 months, registration follows within 1 month of payment and the certificate within a further month. The Agency does not publish average times. With expedited examination, substantive examination is completed within 1 month for a surcharge of AZN 180. A refusal notice or a request for further documents makes the process longer.

Can a foreign company file directly in Azerbaijan?

No. Foreign legal entities and individuals with no business activity in Azerbaijan can deal with the Agency on trademark matters only through a patent attorney registered with the Agency. The power of attorney does not need to be notarised. A Madrid designation of Azerbaijan needs no local attorney at filing, but you must appoint one if you receive a provisional refusal and need to reply or request a review.

Is there an opposition period in Azerbaijan?

No. Applications are not published, the law provides no pre-registration opposition, and earlier marks are searched and refused by the examiner ex officio. After the registration notice, interested parties can ask the Appeals Board to invalidate the registration: on relative grounds within 5 years of publication, on absolute grounds at any time during the term; the Board's decision can be challenged in court within 3 months.

What happens if a registered mark is not used in Azerbaijan?

If the mark is not used for 5 consecutive years from the registration date, or during the 5 years before a revocation request, anyone can ask the Appeals Board to revoke the registration, and the burden of proving use lies with the owner. Keep dated evidence of use in Azerbaijan: sales contracts, invoices, customs declarations, advertising and trade fair materials.

Is Azerbaijan in the Eurasian Economic Union? Does a Eurasian patent protect trademarks?

No on both counts. The Eurasian Economic Union's members are Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia, not Azerbaijan, and the EAEU trademark being prepared will not cover Azerbaijan. Azerbaijan is a member of the Eurasian Patent Organization, but Eurasian patents cover inventions only and have nothing to do with trademarks. To protect a trademark in Azerbaijan, you file directly or designate Azerbaijan through Madrid.

Other IP rights

Patents: Azerbaijani invention patents last 20 years from the filing date (extendable by up to 5 years for products requiring regulatory approval) and utility models 10 years; both are filed with the Intellectual Property Agency. PCT applications can enter the Azerbaijani national phase (the PCT has applied to Azerbaijan since 25 December 1995), and a Eurasian patent from the Eurasian Patent Office also takes effect in Azerbaijan.

Industrial designs: design patents are protected for 10 years from the filing date, extendable by up to 5 years; Azerbaijan can also be designated under the Geneva Act of the Hague Agreement (since 8 December 2010).

Patent applications are handled through an affiliated patent agency.
