Trademark registration in Tajikistan

To register a trademark in Tajikistan, file with the National Center for Patents and Information (NCPI) or designate Tajikistan through the Madrid System. Applicants abroad filing directly must use a patent attorney registered with the NCPI. Examiners search earlier marks, and there is no fixed opposition period: anyone may file written observations after publication.

Trademarks in Tajikistan: key facts

OfficeThe State Institution "National Center for Patents and Information" (NCPI), under the Ministry of Economic Development and Trade and designated as the "Patent Office" under the law, receives applications, examines, registers, issues certificates and publishes; its Appeals Board hears appeals, invalidation requests and requests for termination for non-use. Website and search links: IP Toolbox.
LawLaw on Trademarks and Service Marks No. 234 of 5 March 2007 (amended in 2012 and 2019); Rules on filing and examining trademark applications approved by Order No. 2 of 2022 of the Ministry of Economic Development and Trade; state fees under Annex 11 to Government Resolution No. 476 of 8 September 2025, procedural fees under the annex to Resolution No. 497 of 2011
Madrid SystemParty to the Madrid Agreement (since 25 December 1991) and the Madrid Protocol (since 30 June 2011), so Tajikistan can be designated through Madrid; it has declared an individual fee and an 18-month refusal period, which do not apply to designations from an office of origin party to both treaties (Article 9sexies of the Protocol)
Eurasian Economic UnionTajikistan is not a member of the Eurasian Economic Union, so the EAEU trademark does not concern it; it is a member of the Eurasian Patent Organization, which deals only with patents, not trademarks
Foreign applicantsIndividuals residing permanently outside Tajikistan and foreign legal entities must act through a patent attorney authorised under Tajik law and holding a power of attorney; the power of attorney is valid for no more than 3 years
Language and contentThe application is in Tajik or Russian; one application covers one mark and can include several classes; a description of the mark is required; attachments in other languages need a Tajik translation within 2 months of the NCPI's notice
Scope of examinationAfter formal examination, the mark is examined ex officio on absolute grounds (distinctiveness, descriptiveness, deception) and against earlier applications, earlier registrations and well-known marks that are identical or similar for similar goods
Examination time (statutory)Formal examination within 1 month of the filing date; no statutory period for examination of the mark; office actions must be answered within 2 months, extendable by up to 6 months; if 8 months pass from the office action without a reply, the application is deemed withdrawn
Expedited examination (paid official service)Examination of the mark within 2 months can be bought for a fee (priced separately for word, figurative, three-dimensional and combined marks); expedited formal examination and certificate issue within 10 days are also offered
Observations and invalidation (statutory)Applications that pass formal examination are published in the official bulletin "Навиди патентӣ"; from publication until the examination decision, anyone may submit written reasons why the mark should not be registered, with no fixed opposition period; after registration, invalidation based on an earlier mark must be requested from the Appeals Board within 5 years of publication, on absolute grounds at any time

Which route

Direct filing or a Madrid designation

Both routes lead to protection in Tajikistan. They differ in prerequisites, whether you must appoint a local attorney first, fee structure, whether expedited examination is available, and dependency risk. The NCPI examines Madrid designations on the same absolute grounds and against the same earlier marks as direct applications, and notifies any refusal within the Madrid refusal period.

ItemDirect filing with the NCPIMadrid designation of Tajikistan

Official feesSet in calculation indices and paid in somoni: at filing, the state fee (filing fee) and the procedural fee (examination fee, plus 14% VAT); after acceptance, the registration and certificate fee and the publication feeBasic fee paid to the World Intellectual Property Organization (WIPO), plus: if your office of origin is party to both the Madrid Agreement and the Protocol (e.g. China), only the CHF 100 complementary fee for Tajikistan (and a supplementary fee for more than 3 classes), as Article 9sexies of the Protocol excludes the individual fee; from other offices of origin, Tajikistan's individual fee in Swiss francs. See the WIPO fee calculator
Patent attorney in TajikistanRequired from filing for applicants based abroadNot needed to file; required to answer a provisional refusal or make submissions to the NCPI
Examination timeFormal examination within 1 month (statutory); no statutory period for examination of the mark, but paid expedited examination within 2 monthsThe NCPI must notify a provisional refusal within the Madrid refusal period: 18 months under its declaration, or 12 months for designations from an office of origin party to both the Agreement and the Protocol; no expedited option
After a refusalRequest a review within 2 months of receiving the decision, or appeal to the Appeals Board within 3 monthsReply to the NCPI through a patent attorney in Tajikistan within the period notified under the Madrid System

Dependency riskNoneIf the basic application or registration is refused or cancelled within 5 years, the Tajik designation falls with it
Best forYou only need Tajikistan; you have no home filing to rely on; you want paid expedited examinationYou already have a home filing and want protection in several countries

Tajikistan is not a member of the Eurasian Economic Union. The single trademark arrangement of EAEU members such as Kazakhstan, Kyrgyzstan and Russia is covered in Trademark registration in Russia and does not concern Tajikistan; the Eurasian Patent Organization, of which Tajikistan is a member, deals only with patents.

What to prepare

Documents checklist

For a direct application to the National Center for Patents and Information, applicants based abroad usually prepare the following information and documents.

Applicant

  • Name (for a company, its registered name)
  • Address (the company's seat or the individual's residence); the application form is completed by the attorney in Tajik or Russian

Power of attorney

  • A power of attorney for a patent attorney in Tajikistan, stating the scope of authority; valid for no more than 3 years
  • Provide the power of attorney and other signed documents as your attorney instructs

The mark

  • A clear representation; if you claim a colour or a combination of colours, file the mark in the colours claimed
  • A written description of the mark (a statutory part of the application): what the elements are, how they are composed and what they mean, with the meaning of any foreign word
  • Word, figurative, three-dimensional and combined marks, as well as sound, light, motion, position, holographic and colour-only marks, are filed in the form appropriate to their type

Goods and services

  • Grouped under the Nice Classification, in Tajik or Russian
  • Goods not listed cannot be added during examination; they need a new application

Priority and consent (if any)

  • Earlier application filed abroad: priority can be claimed within 6 months; declare it at filing or within 2 months after, and file the supporting documents within 3 months
  • Consent of the owner of an earlier mark to the registration of a similar mark: consent works only for "similar" marks, and a mark identical to the earlier one cannot be registered on the strength of consent; the form of the consent follows your attorney's instructions

Attachments in another language need a Tajik translation within 2 months of the NCPI's notice. The filing date is the date on which the application form, the representation of the mark and the list of goods have all reached the NCPI; if they arrive separately, the date of the last one counts. Proof of payment of the filing fee is filed with the application; applications can be delivered in person, by post or electronically through the NCPI's official e-mail, with the originals of an electronic filing submitted during formal examination.

How long

Process and timeline

Example: a direct application with no office action.

  1. Step 1

    Clearance search (recommended)

Search for identical and similar marks, check what the mark means in Tajik and Russian, and settle the classes and wording; the NCPI offers a paid search with results within 14 days

  2. Step 2

    Appoint an attorney and file

The attorney files in Tajik or Russian and pays the filing state fee and the examination procedural fee; the filing date is the date on which the form, the representation and the list of goods are all in (statutory)

  3. Step 3

    Formal examination and publication

Completed within 1 month of the filing date (statutory); if the application passes, the NCPI publishes it in the official bulletin, and anyone may submit written observations until the examination decision

  4. Step 4

    Examination of the mark

No statutory period; office actions must be answered within 2 months, extendable by up to 6 months (statutory); paid expedited examination is completed within 2 months

  5. Step 5

    Acceptance and payment

Pay the registration and certificate state fee and the publication procedural fee within 2 months of receiving the decision (statutory); after 8 months without payment the application is deemed withdrawn; if you disagree with the decision, request a review within 2 months or appeal to the Appeals Board within 3 months

  6. Step 6

    Registration, publication and certificate

Entered in the State Register of Trademarks and published within 1 month of payment; the certificate is issued within 1 month of registration (statutory)

The NCPI does not publish average examination times and the law sets no period for examination of the mark, so this page gives no overall estimate. The fixed statutory points are: formal examination 1 month; payment within 2 months of acceptance; registration 1 month; certificate 1 month; the paid expedited service promises examination of the mark within 2 months. Decisions of the Appeals Board can be challenged in court.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

How much

Official fees

Official fees in Tajikistan come in two parts: state fees under Annex 11 to Government Resolution No. 476 (filing, registration and certificate, renewal, changes) and procedural fees paid to the NCPI under the annex to Resolution No. 497 (examination, publication, recording of contracts, appeals), the latter plus 14% VAT. Both are set as multiples of the calculation index, which each year's State Budget Law fixes: TJS 78 since 1 January 2026. At filing you pay the filing state fee and the examination procedural fee, each including the first class, with each class from the 2nd charged separately; after acceptance you pay the registration and certificate state fee and the publication procedural fee, per application.

Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: an application covering 3 classes pays at filing a filing fee of 2.8 + 1 + 1 = 4.8 indices, TJS 374.40, and an examination procedural fee of 25 + 10 + 10 = 45 indices, TJS 3,510; publishing the application after formal examination costs 3 indices, TJS 234. After acceptance, the registration and certificate fee of 16 indices, TJS 1,248, and the registration publication fee of 20 indices (black and white), TJS 1,560. Official fees total TJS 6,926.40 before VAT (state fees TJS 1,622.40, procedural fees TJS 5,304); with 14% VAT of TJS 742.56 on the procedural fees, about TJS 7,669 in all.

Publication fees are higher for marks in colour: 5 indices for publishing the application and 30 for publishing the registration. Expedited examination is a separately charged service not included in the example: examination of the mark within 2 months costs TJS 575 for a word mark, 690 for a figurative mark, 748 for a three-dimensional mark and 805 for a combined mark (each further class charged separately, all plus 14% VAT; price list in force since 6 July 2022).

The calculation index is fixed by each year's State Budget Law: TJS 78 for 2026 (TJS 75 in 2025). Fees are calculated at the index in force when you pay, so the somoni amounts move with it.

Amounts converted into other currencies depend on the somoni exchange rate on the day of payment. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

Watch out

Rules specific to Tajikistan and common refusals

These are the most common issues in Tajik examination, along with Tajikistan-specific rules that are easy to overlook.

No fixed opposition period: anyone may file observations after publication, and invalidation stays open for 5 years

A rule particular to Tajikistan: once an application passes formal examination it is published in the official bulletin, and from publication until the examination decision anyone may submit written reasons to the NCPI why the mark should not be registered, which the examiner takes into account; there is no fixed opposition window. After registration, invalidation based on an earlier mark must be requested from the Appeals Board within 5 years of publication of the registration; on absolute grounds or against a filing by an agent, at any time during the term. To catch conflicting applications, monitor the bulletin continuously.

No statutory period for examination of the mark: pay for expedited examination if you are in a hurry

The law sets only the 1-month formal examination period; it sets no period for examination of the mark, and the NCPI publishes no average times. If you need the certificate quickly, you can pay for the expedited service, which promises examination of the mark within 2 months, and for certificate issue within 10 days. Budget the expedited fees as a separate line.

Acceptance is not registration: pay within 2 months, deemed withdrawn after 8

After receiving the decision to register, you must pay the registration and certificate state fee and file proof of payment within 2 months; an extension can be requested (2.5 indices per month). If 8 months pass from the decision without payment or a request for extension, the application is deemed withdrawn. Office actions work the same way: 2 months to reply, extendable to 6, deemed withdrawn after 8. Exclusive rights arise only on registration, so watch both 8-month limits.

3 consecutive years of non-use: anyone may ask the Appeals Board to terminate the registration

After 3 consecutive years of non-use following registration, anyone may ask the NCPI's Appeals Board (not a court) to terminate the registration early, in whole or in part, and the owner must prove use. Use on goods, packaging, business documents, in advertising and in an internet domain name all count, and circumstances beyond the owner's control can be raised in defence. Keep dated evidence.

Unrecorded contracts are void, and a power of attorney lasts only 3 years

Assignments, licences and other contracts disposing of a trademark must be recorded with the NCPI; unrecorded contracts are void, and an assignment must not mislead consumers about the goods or their producer. A power of attorney for a patent attorney is valid for no more than 3 years, so long-term maintenance needs renewed powers.

Earlier marks are searched ex officio; consent overcomes similarity only

A mark identical or confusingly similar to an earlier application, an earlier registration or a well-known mark, for similar goods, is refused ex officio. With the earlier owner's consent, only a mark "similar" to the earlier one can be registered; an identical mark cannot be registered on the strength of consent. Descriptive signs, generic names and deceptive signs are refused on absolute grounds unless distinctiveness has been acquired through use; before filing a foreign-language mark, check whether it is descriptive or has a negative meaning in Tajik or Russian.

After registration

Keeping the registration

A Tajik registration needs no periodic declarations of use, but non-use can lead to termination, and the registration ends if the renewal grace period is missed.

FAQ

Trademark registration in Tajikistan

How much does a Tajikistan trademark cost?

Official fees consist of state fees and procedural fees, both set in calculation indices; in 2026, 1 index = TJS 78. At filing you pay a filing fee of 2.8 indices (1 class included, 1 index per further class) and an examination procedural fee of 25 indices (1 class included, 10 indices per further class, plus 14% VAT); after acceptance, a registration and certificate fee of 16 indices and a registration publication fee of 20 indices (plus VAT). For 3 classes, official fees total TJS 6,926.40 before VAT, about TJS 7,669 with 14% VAT on the procedural fees. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

How long does trademark registration in Tajikistan take?

The statutory points are: formal examination within 1 month of the filing date; no statutory period for examination of the mark; payment within 2 months of acceptance; registration within 1 month of payment and the certificate within 1 month of registration. The NCPI publishes no average examination times. If you are in a hurry, you can pay for expedited examination of the mark within 2 months and for certificate issue within 10 days.

Can a foreign company file directly with the NCPI?

No. Individuals residing permanently outside Tajikistan and foreign legal entities must deal with the NCPI through a patent attorney qualified under Tajik law and holding a power of attorney, which is valid for no more than 3 years. If you designate Tajikistan through the Madrid System, you need no local attorney to file, but you must appoint one to answer a provisional refusal or make submissions to the NCPI.

Is there an opposition period in Tajikistan?

There is no fixed opposition period. Once an application passes formal examination it is published in the official bulletin, and from publication until the examination decision anyone may submit written reasons to the NCPI why the mark should not be registered, which are taken into account in examination. After registration, invalidation on relative grounds such as an earlier mark must be requested from the Appeals Board within 5 years of publication of the registration; invalidation on absolute grounds is not time-limited.

Does a Eurasian Economic Union trademark or a Eurasian patent cover Tajikistan?

Neither does. Tajikistan is not a member of the Eurasian Economic Union, so the EAEU single trademark does not cover it; for the member states, see Trademark registration in Russia. Tajikistan is a member of the Eurasian Patent Organization, but Eurasian patents cover inventions only, not trademarks. To protect a trademark in Tajikistan, file directly with the NCPI or designate Tajikistan through the Madrid System.

What happens if a registered mark is not used in Tajikistan?

After 3 consecutive years of non-use following registration, anyone may ask the NCPI's Appeals Board to terminate the registration early, in whole or in part, and the owner must prove use. Use on goods, labels, packaging, business documents, in advertising, at exhibitions and in an internet domain name, as well as use by a licensee, can serve as evidence; keep dated sales contracts, invoices and advertising.

Other IP rights

Patents: Tajik invention patents last 20 years from the filing date and "small patents" (granted after preliminary examination) 10 years, both handled by the NCPI; PCT applications can enter the Tajik national phase (the PCT has applied to Tajikistan since 25 December 1991). Tajikistan is a member of the Eurasian Patent Organization, so a Eurasian patent can cover Tajikistan.

Industrial designs: design patents are protected for 10 years from the filing date, extendable by up to 5 years; Tajikistan can also be designated under the Hague Agreement (since 21 March 2012).

Patent applications are handled through an affiliated patent agency.
