Both routes lead to protection in Kyrgyzstan. They differ in prerequisites, whether you must appoint a local patent attorney first, fee structure and dependency risk.

The treaty on the Eurasian Economic Union trademark (one application covering Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia) entered into force on 26 April 2021, and Kyrgyzstan's fee regulations already list EAEU trademark fees, but as of the check date no official announcement that filing has opened could be found; in September 2026, the common procedures for the system were still under discussion on the Russian side (see Trademark registration in Russia). Until then, protection in Kyrgyzstan requires a direct application or a Madrid designation.

For a direct application in Kyrgyzstan, prepare the following information and documents.

Applicant

  • Name (for a company, its registered name)
  • Address and email address: the law requires an email address in the application, and the office's notices and decisions can be sent by email, being deemed served once sent

Power of attorney

  • A power of attorney for a Kyrgyz patent attorney, stating the attorney's name, the scope of authority and the date of signature (an undated power of attorney is invalid)
  • For a company, signed by its head and bearing the company seal; by law no notarisation is needed, but the office can request consular legalisation if it doubts the document's authenticity
  • Provide the power of attorney and other signed documents as your attorney instructs

The mark

  • Word marks: the wording
  • Figurative or combined marks: a clear representation, in the colours for which protection is sought; three-dimensional marks also need each view
  • In the description of the mark, wording not in Kyrgyz or Russian, in any script, needs a transliteration in Cyrillic letters and, if it has a meaning, a translation

Goods and services

  • Grouped under the Nice Classification, in precise terms that identify the specific goods or services
  • Goods added after filing are not accepted; new goods need a new application

Priority and consent (if any)

  • Earlier application filed abroad: priority can be claimed within 6 months; declare it at filing or within 2 months after, and file the priority document within 2 months
  • If your mark is similar to an earlier mark, trade name or industrial design, you can file the earlier owner's written consent; consent cannot be withdrawn once given

The filing date is the day on which all annexes, including proof of payment, the description of the mark and the power of attorney, have reached the office; if they arrive separately, the last one counts. Have the power of attorney and the official fees ready before filing.

Applications can be filed electronically or on paper; for applicants based abroad, the attorney files on their behalf.

The office does not publish average examination times; the periods above are all statutory. If you disagree with an examination decision, you can file an objection with the Appeals Board within 3 months of the decision, which must decide within 3 months (statutory); the process takes longer accordingly.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

Official fees

Official fees are paid in Kyrgyz som and set in "calculation indices" under the Regulations on Fees, 1 index being KGS 100. They are paid in two stages: at filing, the filing and formal examination fee (per application) together with the examination fee (covering the first class, with each extra class charged separately); after acceptance, the registration, publication and certificate fee, regardless of the number of classes. Non-residents can also pay the equivalent in a freely convertible currency at the National Bank of the Kyrgyz Republic's rate on the day of payment. The trademark fees in the table below have applied since 26 October 2016; the 2022 and 2024 amendments to the Regulations did not change them.

Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: an application covering 3 classes pays at filing a filing and formal examination fee of KGS 5,000 plus an examination fee of 15,000 + 2 × 7,500 = KGS 30,000, KGS 35,000 in all; after acceptance, the KGS 15,000 registration fee: KGS 50,000 in official fees in total.

If proof of payment is not filed with the application but follows within 3 months, the filing and examination fees rise by 20%; a registration fee paid in the second 3-month period carries a 50% surcharge.

Rules specific to Kyrgyzstan and common refusals

These are the most common issues in Kyrgyz examination and maintenance, along with Kyrgyzstan-specific rules that are easy to overlook.

Anyone can oppose within 3 months of publication

A rule particular to Kyrgyzstan: once an application passes the formal examination, it is published on the office's website, and within 3 months of publication anyone can file a written opposition, on absolute grounds such as lack of distinctiveness or on earlier rights such as marks and trade names; the examiner considers it during substantive examination. After registration, invalidation based on earlier rights must be sought from the Appeals Board within 5 years of publication of the registration; requests on absolute grounds have no time limit.

Assignments and licences are void unless recorded

Assignment, licence, pledge and franchise agreements must all be recorded with the office for a fee; an unrecorded agreement is void, not merely unenforceable against third parties. If you license a distributor or licensee to use the mark in Kyrgyzstan, or acquire someone else's mark, build the recordal into your timetable.

The country's name and cultural heritage cannot be the core of a mark

Signs containing the full or short name of the Kyrgyz Republic or derivatives of it, and signs identical or similar to the official names and images of the cultural heritage of the peoples of Kyrgyzstan or of world cultural and natural heritage, are refused; only with the consent of the competent authority, and if they are not dominant, can they remain in the mark as unprotected elements.

Revocation after 3 years of non-use: proposal first, then court

After 3 consecutive years of non-use after registration, an interested party first sends the owner a proposal to surrender the mark or assign it to the party; if nothing is done within 2 months, it can sue for revocation of all or some of the goods within the following 30 days. The owner bears the burden of proving use; after an assignment or licence, the 3 years run from the date the agreement was recorded.

Missing annexes postpone the filing date

Kyrgyzstan takes as the filing date the day on which all annexes, including proof of payment, the description of the mark and the power of attorney, have reached the office; if they arrive separately, the last one counts. When claiming priority or racing another filer, sign the power of attorney and pay the filing and examination fees before filing, and file everything together. The law also protects only visually perceptible signs: sound and smell marks are not accepted.

Broad earlier rights; consent can overcome similarity

The examiner compares earlier applied-for or registered marks, trade names registered in Kyrgyzstan, industrial designs, titles of well-known works and names of well-known people. If your mark is similar to an earlier mark, trade name or industrial design, it can be registered with the earlier owner's written consent, which cannot be withdrawn once given.

A Kyrgyz registration needs no periodic declarations of use, but non-use can lead to revocation, unrecorded assignments and licences are void, and the registration ends if the renewal grace period is missed.

For 1 year after a registration ends (expiry without renewal, surrender by the owner or liquidation of the company), the same mark cannot be registered in another person's name. Kyrgyzstan is a member of the Eurasian Economic Union: Chapter 52 of the EAEU Customs Code provides customs measures to protect IP rights, including suspending the release of suspected infringing goods; once registered, you can apply as your attorney advises. E-commerce brand registries usually also require a registered or pending trademark.

For 3 classes, official fees total KGS 50,000. Renewal costs KGS 30,000 every 10 years, regardless of the number of classes. How long does trademark registration in Kyrgyzstan take?

The office publishes no average times. The statutory milestones are: formal examination within 10 working days; a 3-month opposition period after publication; substantive examination completed within 7 months of the filing date; the registration fee paid within 3 months of acceptance; publication within 1 month of registration and the certificate within 1 month of publication. Responding to a provisional refusal, an opposition or an appeal makes the process longer.

Can a foreign company file directly in Kyrgyzstan?

Not by itself. Foreign legal entities and individuals domiciled outside Kyrgyzstan must act through a Kyrgyz patent attorney registered with the office, and the power of attorney needs no notarisation. If you designate Kyrgyzstan through the Madrid System, you need no local attorney to file, but you must appoint one to answer a provisional refusal.

Can I file a Eurasian Economic Union trademark now?

As of the check date, no official announcement that filing has opened could be found. The Treaty on EAEU trademarks entered into force on 26 April 2021, and Kyrgyzstan's fee regulations already list filing, examination and registration fees for EAEU trademarks, but the system is still being put into practice. What happens if a registered mark is not used in Kyrgyzstan?

After 3 consecutive years of non-use, an interested party can send the owner a proposal and, after 2 months, sue within 30 days for revocation of all or some of the goods. The owner must prove use, so keep dated evidence of use in Kyrgyzstan, such as sales contracts, invoices and advertising; non-use caused by circumstances beyond the owner's control, such as state restrictions, can be raised as a defence.

Other IP rights

Patents: Kyrgyz invention patents last 20 years from the filing date and utility models 10 years, both handled by the Ministry of Science, Higher Education and Innovation. PCT applications can enter the Kyrgyz national phase (the PCT has applied to Kyrgyzstan since 25 December 1991), and Kyrgyzstan is a party to the Eurasian Patent Convention, so a Eurasian patent from the Eurasian Patent Office can also take effect in Kyrgyzstan.

Industrial designs: design patents are protected for 5 years from the filing date, renewable every 5 years up to 25 years; Kyrgyzstan can also be designated through the Hague Agreement (since 17 March 2003).
