Trademark registration in Uzbekistan

File with Uzbekistan's Ministry of Justice, whose Intellectual Property Centre examines applications, or designate Uzbekistan through Madrid. Foreign direct filers need a patent attorney registered with the Ministry. The examiner checks earlier marks ex officio; there is no opposition period, and substantive examination ends in the 7th month after filing (1 month if expedited).

Which route

Direct filing or a Madrid designation

Both routes lead to protection in Uzbekistan. They differ in prerequisites, whether you must appoint a local attorney first, fee structure, access to expedited examination and dependency risk. The Ministry of Justice examines Madrid designations on the same absolute grounds and earlier-mark criteria as direct applications.

ItemDirect filing with the Ministry of JusticeMadrid designation of Uzbekistan
PrerequisiteNoneA basic application or registration at your office of origin
Official feesSet in БРВ and paid in Uzbek som: the filing and examination fee per class at filing; registration, publication and certificate fees after acceptanceBasic fee and the fee for designating Uzbekistan (in Swiss francs; see the WIPO fee calculator) paid to the World Intellectual Property Organization (WIPO)
Local attorneyRequired from filing for applicants based abroad: a patent attorney registered with the Ministry of JusticeNot needed to file; required when a provisional refusal has to be answered before the Ministry
Examination speed (statutory)Within 7 months of the filing date, but not before 6 months; expedited examination can be requested within 3 months and is completed within 1 month of acceptanceThe Administrative Regulation provides no expedited procedure for international registrations
After a refusalAppeal to the Ministry of Justice's Appeals Council within 3 months of the decisionRespond to the Ministry within 6 months of a provisional refusal
Wording of goods and servicesTerms must match those of the current Nice ClassificationCannot go beyond the basic application or registration
Dependency riskNoneIf the basic application or registration is refused or cancelled within 5 years, the Uzbek designation falls with it
Best forYou only need Uzbekistan; you have no home filing to rely on; you want registration as quickly as possibleYou already have a home filing and want protection in several countries

Uzbekistan is not a member state of the Eurasian Economic Union. For the unified trademark arrangements of EAEU members such as Kazakhstan, Kyrgyzstan and Russia, see Trademark registration in Russia; they do not apply to Uzbekistan.

What to prepare

Documents checklist

For a direct application to the Ministry of Justice, prepare the following information and documents.

Applicant

  • Name (for a company, its registered name)
  • Address; applicants based abroad also give a country code, and the attorney completes the application online

Power of attorney

  • A power of attorney for the Uzbek patent attorney, stating the scope of authority
  • File it with the application or within 2 months of the filing date (statutory)
  • Provide signed or sealed documents as the attorney instructs

Mark

  • A clear representation showing every element; if colour is claimed, file it in the colours claimed
  • Foreign-language wording, including words in non-Latin scripts, needs a Latin-script Uzbek transliteration and an explanation of what each element consists of and means
  • For three-dimensional, sound, motion, position and other marks, file the representation and description required for that type

Goods or services

  • Grouped by Nice class, using terms that match the current Nice Classification
  • If the wording is not acceptable, the examiner sends a query asking for amendments; if it is not answered in time, examination continues only for the goods that need no amendment

Priority and consent (if any)

  • Priority from a first application filed abroad can be claimed within 6 months: declare it at filing or within 2 months after, and file a certified copy of the first application with a translation within 3 months
  • If the owner of an earlier mark consents to registration, the letter of consent must name both parties and both marks, list the goods covered and be dated, with a notarised signature; a letter signed abroad needs an apostille or consular legalisation

Documents in other languages must be followed by a translation within 2 months; otherwise the filing date becomes the date the translation is received. Official fees are paid electronically through the government's unified payment system, and an application is not accepted if the filing and examination fee has not been paid at filing.

How long

Process and timeline

Example: a direct application with no examination queries.

  1. Step 1

    Clearance search (recommended)

Search for identical and similar marks, check what the mark means in Uzbek and Russian, and settle the classes and wording

  2. Step 2

    Filing and fee

File online and pay the filing and examination fee; application details are published within 1 working day (statutory)

  3. Step 3

    Formal examination

Completed within 30 days (statutory); if the application is in order, a decision to accept it is issued

  4. Step 4

    Substantive examination

Decision within 7 months of the filing date, but not before 6 months (statutory); if expedited, within 1 month of acceptance (statutory); examination queries must be answered within 3 months, extendable to 6 months in all (statutory)

  5. Step 5

    Acceptance and fees

Pay the registration, publication and certificate fees within 3 months of the decision (statutory); paying in months 3 to 6 costs 50% more

  6. Step 6

    Registration and certificate

Registered automatically on payment, with an electronic certificate bearing a QR code issued the same day, and published in the Ministry of Justice's official bulletin

The Ministry of Justice does not publish average trademark examination times. Based on the statutory deadlines, an application with no examination queries takes about 7 to 10 months from filing to registration (estimate: 6 to 7 months to the substantive decision plus up to 3 months to pay the fees); expedited examination shortens this considerably. After a refusal, you can appeal to the Ministry's Appeals Council within 3 months of the decision (statutory), and challenge the Council's decision in court within 6 months.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

How much

Official fees

Uzbek official fees are set as multiples of the base calculation amount (БРВ), with separate rates for individuals and legal entities; companies pay the legal-entity rates. Fees are paid in two stages: at filing, the filing and examination fee, which covers the first class, with each class from the 2nd charged separately; after acceptance, the registration, publication and certificate fees, charged per application. The multiples are set in item 12 of the annex to the Law on State Duty and have applied since 1 January 2025; amounts in Uzbek som change with the БРВ, which has been UZS 440,000 since 1 September 2026.

Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: a legal entity filing in 3 classes pays 6 + 1 + 1 = 8 БРВ at filing, or UZS 3,520,000; after acceptance, it pays registration 2.4 БРВ, publication 0.8 БРВ and certificate 2.4 БРВ, 5.6 БРВ in all, or UZS 2,464,000: 13.6 БРВ, or UZS 5,984,000, in official fees in total.

The БРВ is adjusted by presidential decree: UZS 412,000 from 1 August 2025 and UZS 440,000 from 1 September 2026. Fees are calculated at the БРВ in force on the day of payment, so amounts in som change after each adjustment.

Expedited examination requires a separate search contract with the Intellectual Property Centre; the search charge is not in the schedule of state duties and is not included in the example above.

Amounts converted into other currencies depend on the som exchange rate on the day of payment.

Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

Watch out

Rules specific to Uzbekistan and common refusals

These are the most common issues in Uzbek examination, along with rules specific to Uzbekistan that are easy to overlook.

Earlier marks are checked ex officio, and consent only overcomes similarity

If the mark is identical or confusingly similar to an earlier application or registration for similar goods, the examiner refuses it ex officio. With the earlier owner's consent, a similar mark can be registered, but the law allows this only for confusingly similar marks; the signature on the letter of consent must be notarised, and a letter signed abroad also needs an apostille or consular legalisation.

No opposition period: bad-faith applications can be objected to before the decision

A rule specific to Uzbekistan: application details are published within 1 working day of filing, and from then until the examination decision, interested parties can file a written objection to a bad-faith application with the Ministry of Justice, which is assessed during examination. Because substantive examination takes place no earlier than 6 months after filing, this period is the main window for watching others' applications. After registration, invalidation based on earlier rights must be sought from the Appeals Council or a court within 5 years of publication of the registration.

Unanswered examination queries mean the application is deemed withdrawn

If the examiner asks for further documents or amendments to the list of goods, you must respond within 3 months; extensions are available up to 6 months in all, with a fee for each extra month. If you neither respond nor request an extension in time, the application is deemed withdrawn; it can be reinstated within 2 months on payment of a fee.

Late registration fees cost more, and acceptance is not registration

After acceptance, the registration, publication and certificate fees must be paid within 3 months of the decision, and the mark is registered automatically only once they are paid; paying in months 3 to 6 costs 50% more. Exclusive rights arise only from the date of registration, so keep track of the payment deadline.

3 years of non-use can lead to termination by a court

After 3 consecutive years of non-use following registration, an interested party can ask a court to terminate the registration early, in whole or in part; the owner can submit evidence that circumstances beyond its control prevented use. Use in advertising, on labels, in business documents and in domain names counts as use; keep dated evidence.

Descriptive marks and meanings in other languages

Signs that directly describe the kind, quality, purpose or origin of the goods, and generic names, are refused on absolute grounds unless they have acquired distinctiveness through use. Foreign wording needs a Latin-script Uzbek transliteration; before filing, check whether the mark has a descriptive or negative meaning in Uzbek or Russian.

After registration

Keeping the registration

An Uzbek registration needs no periodic declarations of use, but non-use can lead to termination, and the registration ends if the renewal grace period is missed.

Once registered, you can apply under the Customs Code to have the mark entered in the customs register of intellectual property, so that customs can suspend the release of suspected infringing goods. For 3 years after a registration expires or is surrendered, no one else can register the mark. E-commerce brand registries usually also require a registered or pending trademark.

FAQ

Trademark registration in Uzbekistan

How much does it cost to register a trademark in Uzbekistan?

Official fees are set in base calculation amounts (БРВ), and companies pay the legal-entity rates: 6 БРВ at filing for filing and examination (1 class included), plus 1 БРВ for each extra class, and 5.6 БРВ after acceptance for registration, publication and the certificate. From 1 September 2026, 1 БРВ is UZS 440,000, so official fees for 3 classes total 13.6 БРВ, or UZS 5,984,000. Service fees are quoted by the agent after you submit the order.

How long does trademark registration take in Uzbekistan?

The statutory milestones are: formal examination within 30 days; a substantive decision within 7 months of the filing date, but not before 6 months; fees payable within 3 months of acceptance, after which the mark is registered automatically and an electronic certificate issued the same day. On that basis, a straightforward application is registered in about 7 to 10 months (estimate). If you request expedited examination within 3 months of filing and sign a search contract with the Intellectual Property Centre, examination is completed within 1 month of acceptance.

Can a foreign company file directly in Uzbekistan?

Not on its own. Individuals domiciled outside Uzbekistan and foreign legal entities must act through a patent attorney registered with the Ministry of Justice. A Madrid designation of Uzbekistan needs no local attorney at filing, but one is required to respond to a provisional refusal.

Is there an opposition period for trademarks in Uzbekistan?

There is no pre-registration opposition period. After the application is published and before the examination decision, interested parties can file a written objection to a bad-faith application with the Ministry of Justice, which is assessed during examination. After registration, invalidation on relative grounds such as an earlier mark must be sought from the Ministry's Appeals Council or a court within 5 years of publication of the registration; requests on absolute grounds have no time limit.

Does a Eurasian Economic Union trademark cover Uzbekistan?

No. Uzbekistan is not a member state of the Eurasian Economic Union. For protection in Uzbekistan, file directly with the Ministry of Justice or designate Uzbekistan through the Madrid System; for the position in EAEU member states, see Trademark registration in Russia.

What happens if a registered trademark is not used in Uzbekistan?

After 3 consecutive years of non-use following registration, an interested party can ask a court to terminate the registration early, in whole or in part. Use on goods or packaging, in advertising, on labels, in business documents or in domain names, as well as use by a licensee, counts as evidence of use; keep dated sales contracts, invoices, advertisements and similar records.
