Key facts

Trademarks in Ukraine: key facts

OfficeThe state organisation Ukrainian National Office for Intellectual Property and Innovations (Державна організація «Український національний офіс інтелектуальної власності та інновацій», УКРНОІВІ, UANIPIO) has exercised the functions of the national IP office (НОІВ) under the Trademark Law since 8 November 2022: it receives, examines and registers applications and issues certificates; appeals against examination decisions are heard by its Appeals Chamber (Апеляційна палата). Website and search links: IP Toolbox.
LawLaw on the Protection of Rights to Marks for Goods and Services (No. 3689-XII of 15 December 1993; extensively amended by Law No. 815-IX of 2020, in force since 16 August 2020; current text as of 26 February 2026); filing and examination rules in Ministry of Economy Order No. 19889 of 2024 (in force since 18 September 2024); official fees under the Payment Procedure and its annex adopted by Cabinet of Ministers Resolution No. 1716 of 2004
Madrid SystemParty to the Madrid Agreement (applied to Ukraine since 25 December 1991) and the Madrid Protocol (since 29 December 2000), so Ukraine can be designated through Madrid; Ukraine has declared an 18-month refusal period and an individual fee. Under Article 9sexies of the Protocol, neither declaration applies to designations from an office of origin bound by both treaties (such as China): those applicants pay only the CHF 100 complementary fee (plus a supplementary fee beyond 3 classes) and the refusal period is 12 months
Foreign applicantsIndividuals and legal entities domiciled or established outside Ukraine must conduct all dealings with UANIPIO (filing, replies, appeals, renewals) through a registered patent attorney (патентний повірений)
Language and formUkrainian; on paper or through UANIPIO's electronic filing system (e-filings need a qualified electronic signature); foreign-language documents come with a Ukrainian translation; applicants abroad give their name and address in Latin or Cyrillic letters with a Ukrainian transliteration, and legal entities add their foreign registration number
Classes and filing feeOne application covers one mark and can include several Nice classes; the filing fee is charged per class and must be paid within 2 months of the filing date, extendable for a fee by up to 6 months; otherwise the application is deemed withdrawn
Publication and opposition (statutory)Within 5 working days of the filing date being confirmed by formal examination, the application is published in the official electronic bulletin and entered in the applications database; anyone can file a reasoned opposition (with a fee) within 3 months of publication, and the applicant has 2 months to reply; oppositions are decided together with substantive examination
Substantive examination and reply periods (statutory)Absolute grounds and earlier rights (earlier marks, trade names and others) are examined; a provisional refusal is issued only once, and the applicant has 2 months from receipt to reply, extendable for a fee by up to 6 months, with restoration possible for a fee within 6 months after a missed deadline; the law sets no deadline for completing examination
Fees after approval (statutory)Within 3 months of receiving the registration decision, pay the state duty for the certificate and the publication fee; otherwise the mark is not published and the application is deemed withdrawn; extendable for a fee by up to 6 months, and restorable for a fee within 6 months if the deadline was missed for a valid reason
Term and renewal10 years from the filing date, renewable for 10 years each time; the renewal request and fee are filed before expiry, the fee being paid in the last 6 months of the term; renewal is still possible within 6 months after expiry with a 50% surcharge
Non-use (statutory)If the mark has not been used in Ukraine for 5 consecutive years from publication of the registration, or use is later interrupted for 5 consecutive years, anyone can ask a court to terminate the registration early for all or some of the goods, unless there are valid reasons beyond the owner's control
Review and appealsA UANIPIO decision can be challenged within 2 months of receipt by an objection to the Appeals Chamber or an action in court; the Appeals Chamber normally decides within 2 months, extendable by 2 months for a fee; once the certificate duty has been paid, no further appeal to the Appeals Chamber is possible
Wartime suspension of deadlinesLaw No. 2174-IX of 2022 suspended the deadlines in IP proceedings (in force from 13 April 2022, retroactive to 24 February); it was repealed by Law No. 4362-IX of 16 April 2025, and statutory deadlines have applied again since 31 May 2025
Official feesFiling fee UAH 4,000 per class (plus UAH 1,000 for a colour representation), discounted for e-filing; publication fee UAH 600 per class; state duty for the certificate USD 200 for applicants abroad; renewal UAH 12,000 for 1 class plus UAH 1,200 per additional class; the current fee schedule has applied since 16 September 2023

Which route

Direct filing or a Madrid designation

Both routes lead to protection in Ukraine. They differ in prerequisites, whether you must appoint a Ukrainian patent attorney first, fee structure and dependency risk. Madrid designations are examined by UANIPIO on the same absolute grounds and earlier rights as direct applications, and the same 3-month opposition period runs from publication in the bulletin.

ItemDirect filing with UANIPIOMadrid designation of Ukraine
PrerequisiteNoneA basic application or registration at your office of origin
Official feesIn hryvnia, paid in two stages: at filing, the filing fee (per class, discounted for e-filing); after approval, the publication fee (per class) and the state duty for the certificate (paid in US dollars by applicants abroad)Basic fee paid to the World Intellectual Property Organization (WIPO), plus: if your office of origin is bound by both the Madrid Agreement and the Protocol (e.g. China), only the CHF 100 complementary fee for Ukraine (and a supplementary fee for more than 3 classes), as Article 9sexies of the Protocol excludes the individual fee; from other offices of origin, Ukraine's individual fee (one amount for up to 3 classes, plus a fee for each further class, in Swiss francs). See the WIPO fee calculator
Ukrainian attorneyRequired from filing for applicants based abroadNot needed to file; required as soon as you must reply or appeal to UANIPIO, for example after a refusal notice or an opposition
Examination timeStatutory milestones: a 3-month opposition period after publication, 2 months to reply to a provisional refusal, 3 months to pay after approval; no statutory deadline for completing examinationUANIPIO must notify a provisional refusal within the refusal period under the Madrid Protocol: 12 months for designations from an office of origin bound by both treaties (e.g. China), 18 months from other offices of origin, where Ukraine's declaration also allows opposition-based refusals to be notified later; the result is notified through WIPO
Wording of goods and servicesItem by item under the Nice Classification, in Ukrainian; a mark in non-Cyrillic letters comes with a Ukrainian transliteration and, where it has a meaning, preferably a translationCannot go beyond the basic application or registration
Dependency riskNoneIf the basic application or registration is refused or cancelled within 5 years, the Ukrainian designation falls with it

What to prepare

Documents checklist

For a direct application to UANIPIO, applicants based abroad usually prepare the following information and documents.

Applicant

  • Name (for a company, its registered name) and address in Latin letters, with a Ukrainian transliteration added in brackets by the attorney
  • A foreign legal entity gives its registration number in its home country (e.g. company or tax registration number); an individual gives identity document details (not published)

Attorney and power of attorney

  • Applicants based abroad can act only through a registered Ukrainian patent attorney; the power of attorney is filed with the application and signed by the applicant
  • A simple written power of attorney is enough, with a Ukrainian translation if it is in another language; the 2024 Rules do not require notarisation or consular legalisation, and any other signature requirements follow the attorney's instructions
  • One power of attorney can cover several applications; later applications attach a copy and state the number of the application holding the original

The mark

  • One application covers one mark; file a clear representation; to protect colours, declare them and file a colour representation, which raises the filing fee
  • A mark containing words in non-Cyrillic letters (including Chinese characters or other scripts) comes with a Ukrainian transliteration; foreign words should also come with a Ukrainian translation where possible
  • Colour marks need an international colour code (such as Pantone, RAL or Focoltone) and examples of use; sound, three-dimensional, position, motion and other marks need the documents set out in the Rules for their type

Goods and services

  • Listed item by item in Ukrainian under the Nice Classification and grouped by class; the filing fee is charged per class
  • During formal examination UANIPIO may regroup the goods and require fees for additional classes; vague terms that cannot be classified must be replaced or deleted
  • After filing, the list can only be narrowed, not extended; adding goods requires a new application

Priority (if any)

  • Earlier application filed abroad: priority can be claimed within 6 months; the priority declaration, a copy of the earlier application and its Ukrainian translation must be filed within 3 months of the filing date, or the priority claim is lost

The filing fee must be paid within 2 months of the filing date, extendable for a fee by up to 6 months; otherwise the application is deemed withdrawn. E-filings need a qualified electronic signature; for applicants abroad, the attorney files on their behalf.

How long

Process and timeline

Example: a direct application with no opposition or refusal.

  1. Step 1

    Clearance search (recommended)

Search Ukrainian trademarks and international registrations designating Ukraine, check what the mark means in Ukrainian and how it transliterates, and settle the classes and wording

  2. Step 2

    Filing and filing fee

Filed by the attorney; the filing fee is paid within 2 months of the filing date (statutory)

  3. Step 3

    Formal examination and publication

Filing-date requirements, formalities and payment are checked; within 5 working days of the filing date being confirmed, the application is published in the official electronic bulletin (statutory)

  4. Step 4

    Opposition period

Anyone can file a reasoned opposition within 3 months of publication (statutory); if one is filed, the applicant has 2 months to reply

  5. Step 5

    Substantive examination

Absolute grounds and earlier rights are examined and any opposition is decided at the same time; if there is a problem, a provisional refusal is issued (only once) and the applicant has 2 months to reply (statutory, extendable for a fee)

  6. Step 6

    Approval, fees and certificate

Within 3 months of receiving the registration decision, pay the state duty for the certificate and the publication fee (statutory); UANIPIO publishes the registration, enters it in the register at the same time and issues the certificate

Ukrainian trademark law sets no deadline for completing formal or substantive examination, and UANIPIO publishes no verifiable statistics on the average time from filing to registration, so this page gives no estimated timeline. An opposition, a refusal or an appeal makes the process considerably longer: a refusal can be challenged before the Appeals Chamber within 2 months of receiving the decision, and the Chamber normally decides within 2 months.

From 13 April 2022 to 30 May 2025, Ukraine suspended the deadlines in IP proceedings under Law No. 2174-IX; that law was repealed on 31 May 2025, and filing, reply, payment and renewal deadlines have since run as set by law.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

How much

Official fees

Ukrainian trademark fees are set in the annex to the Payment Procedure under Cabinet of Ministers Resolution No. 1716, in hryvnia (UAH); the current schedule has applied since 16 September 2023. Applicants abroad can pay in hryvnia, euros or US dollars at the National Bank of Ukraine rate on the day of payment. Fees are paid in two stages: at filing, the filing fee (per class, with a surcharge for a colour representation); after receiving the registration decision, the publication fee (per class) and the state duty for the certificate, which applicants abroad pay in US dollars. E-filed applications pay the filing fee at the discount rate set by the government; the exact rate is the one UANIPIO publishes at the time of payment. The table shows the full rates.

Source: www.wipo.int · The table shows the full rates in force since 16 September 2023; e-filed applications pay the filing fee at the discount rate set by the government. · checked on 2026-10-11 · USD figures are approximate, converted at the Bank of China spot selling rate (or, for currencies it does not quote, at the central bank's published USD rate); the official fee is the amount in the original currency

Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: a black-and-white mark in 1 class pays a UAH 4,000 filing fee at filing; after approval, a UAH 600 publication fee and the USD 200 certificate duty (applicants abroad): UAH 4,600 plus USD 200 in official fees in total.

With 3 classes, the filing fee is 3 × 4,000 = UAH 12,000, plus UAH 1,000 for a colour representation; after approval, the publication fee is 3 × 600 = UAH 1,800, while the certificate duty stays at USD 200 regardless of the number of classes.

Joint applicants pay the filing fee at 130%; each class added at UANIPIO's request during formal examination costs a further UAH 5,000; a mark containing the name of Ukraine or the letter code UA requires a UAH 24,000 permission fee.

Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

Watch out

Rules specific to Ukraine and common refusals

These are the most common issues in Ukrainian examination, along with Ukraine-specific rules that are easy to overlook.

Once published, anyone can oppose

In Ukraine, opposition comes before registration, during substantive examination: the application is published within 5 working days of passing formal examination, and for 3 months afterwards anyone, not just earlier right holders, can pay the fee and file a reasoned opposition. UANIPIO sends a copy to the applicant, who has 2 months to rebut it, amend the application or withdraw; the outcome goes into the examination conclusion, and the opponent can appeal to the Appeals Chamber within 2 months of receiving a copy of the decision, which suspends further proceedings on the application. A search before filing costs less than redrafting after an opposition.

"Україна/Ukraine" or "UA" needs prior permission

If a mark contains the official name of Ukraine, its short name or the international letter code UA (including transliterations and variants), that element can only be included as an unprotected element and needs the permission of the collegiate body set up under UANIPIO (the "Ukraine" commission), with an official fee of UAH 24,000; imitations of the Ukrainian state emblem also need permission. Without it, the element becomes a ground for refusal. The same applies to flags, emblems and the signs of intergovernmental organisations.

No payment within 3 months of approval, and the application is deemed withdrawn

A UANIPIO registration decision is not yet a registration: within 3 months of receiving it, you must pay the state duty for the certificate (USD 200 for applicants abroad) and the UAH 600 publication fee per class; publication and entry in the register happen together. The deadline can be extended for a fee by up to 6 months, and restored for a fee within 6 months if missed for a valid reason; miss both and the application is deemed withdrawn, with the filing fee and the waiting time lost. If you use an attorney, the attorney reminds you and pays on your behalf.

The provisional refusal is issued once: reply fully within 2 months

If substantive examination finds absolute grounds or a conflict with earlier rights, UANIPIO issues a provisional conclusion setting out all grounds for refusal, and it does so only once; the applicant has 2 months from receipt to file a reasoned reply, extendable for a fee by up to 6 months, with restoration possible for a fee within 6 months after a missed deadline. No reply means the application is deemed withdrawn. If the mark is found similar to an earlier mark, you can narrow the list of goods, argue that there is no similarity, or obtain the earlier owner's written consent: the law allows registration with consent, provided consumers would not be misled.

5 years of non-use after publication, and anyone can sue for revocation

If the mark is not used in Ukraine for 5 consecutive years from publication of the registration, or use is later interrupted for 5 consecutive years, anyone can ask a court to terminate the registration early for all or some of the goods; use by a licensee counts as use by the owner, and import restrictions or other circumstances beyond the owner's control can be valid reasons. Keep dated evidence of sales, customs clearance, advertising and website use in Ukraine.

Applicants abroad must appoint a registered patent attorney

Applicants domiciled or established outside Ukraine must conduct all dealings with UANIPIO through a registered patent attorney and cannot file themselves. A simple written power of attorney with a Ukrainian translation is enough; the 2024 Rules do not require notarisation or consular legalisation. If you designate Ukraine through Madrid, no attorney is needed to file, but you must appoint one as soon as you need to reply to UANIPIO after a refusal or an opposition.

After registration

Keeping the registration

A Ukrainian registration needs no periodic declarations of use, but non-use can lead to a court action for revocation, and the registration ends if the renewal grace period is missed.

FAQ

Trademark registration in Ukraine

How much does a Ukrainian trademark cost?

At the rates in force since 16 September 2023: a filing fee of UAH 4,000 per class (discounted for e-filing, plus UAH 1,000 for a colour representation); after approval, a publication fee of UAH 600 per class and the state duty for the certificate, which is USD 200 for applicants abroad. Full official fees come to UAH 4,600 plus USD 200 for 1 class and UAH 13,800 plus USD 200 for 3 classes. Applicants abroad can pay the hryvnia fees in euros or US dollars at the rate on the day of payment. Service fees are quoted by the agent after you submit the order; you pay only after accepting the quote.

How long does trademark registration in Ukraine take?

The law only sets milestones: the filing fee is paid within 2 months of the filing date; the application is published within 5 working days of the filing date being confirmed; the opposition period runs for 3 months from publication; a provisional refusal must be answered within 2 months; the fees are paid within 3 months of receiving the registration decision, after which publication and registration happen together. There is no statutory deadline for completing examination and no verifiable official average, so this page gives no estimated timeline. An opposition, a refusal or an appeal makes it considerably longer.

Can a foreign company file directly with UANIPIO? Does the power of attorney need notarisation?

Not by itself. Applicants domiciled or established outside Ukraine must deal with UANIPIO through a registered Ukrainian patent attorney. A simple written power of attorney signed by the applicant is enough, with a Ukrainian translation if it is in another language; the 2024 Rules do not require notarisation or consular legalisation, and any other signature requirements follow the attorney's instructions. If you designate Ukraine through Madrid, no Ukrainian attorney is needed to file; appoint one when a refusal or an opposition arrives.

Is there an opposition period in Ukraine, and who can oppose?

Yes, and it comes before registration. The application is published in the official electronic bulletin within 5 working days of passing formal examination, and anyone (not just earlier right holders) can file a reasoned opposition within 3 months of publication, paying an official fee of UAH 2,000. The applicant has 2 months to reply; the opposition is decided together with substantive examination and the outcome goes into the examination conclusion; an opponent who disagrees can appeal to the Appeals Chamber within 2 months. The same applies to international registrations designating Ukraine.

What happens if a registered mark is not used in Ukraine?

If the mark is not used in Ukraine for 5 consecutive years from publication of the registration, or use is later interrupted for 5 consecutive years, anyone can ask a court to terminate the registration early for all or some of the goods. Use by a licensee counts as use by the owner, and import restrictions or other circumstances beyond the owner's control can be valid reasons. Keep dated evidence of use in Ukraine, such as sales contracts, invoices, customs declarations, advertising and web pages.

Does the wartime suspension of deadlines still apply?

No. Law No. 2174-IX of 1 April 2022 suspended the deadlines in IP proceedings for the duration of martial law (in force from 13 April 2022, retroactive to 24 February). Law No. 4362-IX of 16 April 2025 repealed it, and since 31 May 2025 filing, reply, payment and renewal deadlines have run as set by law; a missed deadline can only be extended or restored under the ordinary rules.
