Direct filing: whether to claim priority

Bangladesh is not a member of the Madrid System, so it cannot be designated through a Madrid international registration; applications are filed directly with the DPDT through a Bangladeshi advocate or registered trademark agent. The real choice is whether to claim priority from an earlier application filed abroad.

What to prepare

Documents checklist

Applicants filing through a Bangladeshi agent usually prepare the following information and documents. No evidence of use is needed at filing, but you must state the date use began or "proposed to be used".

Applicant

  • Full name and complete address; without them, the DPDT does not allot a filing date or application number
  • For a company, the country under whose laws it is incorporated; for an individual, nationality
  • The nature of the business, such as manufacturer, importer or service provider

The mark

  • A clear representation of the mark (photocopies are not accepted); on a label, indicate which part is the mark applied for
  • The representation must not include the ® symbol or the logos of bodies such as BSTI or ISO
  • For words in a language other than Bengali or English (such as Chinese), a Bengali or English transliteration and translation of each word, stating the language
  • If the label uses someone else's photograph, the consent of that person or their guardian

Goods or services

  • The class and specific goods or services under the Nice Classification; one class per application
  • The exact date use began in Bangladesh; if the mark is not yet used, "Proposed to be used"

Priority

  • To claim priority from an earlier application: file within 6 months of your first application and give its details
  • Attach a certified copy of the earlier application, certified by the agent or advocate

Power of attorney

  • If a Bangladeshi advocate or registered trademark agent files for you, the power of attorney (Form TM-10), original or certified copy, must be filed with the application; without it, the application is not accepted
  • Stamp duty on the power of attorney is paid under Bangladesh's Stamp Act; the agent handles this

The DPDT checklist only requires the original power of attorney or a copy certified by the agent, and lists no notarisation or legalisation requirement; provide the power of attorney and other signed documents following your agent's instructions. Process and timeline

Example: a direct application with no objection and no opposition. Periods marked "statutory" are set by law.

    Clearance search (recommended)

    Search for similar earlier marks first; the DPDT also offers an official search, and its service charter promises the report within 2 weeks

  2. Step 2

    Filing

    One application per class, filed online with the filing fee; if the name and address, goods, class, representation, signature or fee is missing, no filing date or application number is allotted

  3. Step 3

    Examination

    Applications are examined in order of receipt; if there are grounds for refusal, respond to the notice or request a hearing

  4. Step 4

    Acceptance and publication

    Once the application passes examination, the DPDT asks for the publication fee; after payment, the mark is published in the Trademarks Journal

  5. Step 5

    Opposition period

    2 months from publication (statutory); if opposed, the counter-statement is due within 2 months of receiving the notice of opposition (statutory), and the whole opposition procedure is to be concluded within 330 working days (statutory)

    Registration fee and certificate

    If there is no opposition by the end of the period, pay the registration fee and the certificate is issued; with no defects and no opposition, the law requires this within 150 working days of filing (statutory); the registration date is the filing date

The DPDT publishes no verifiable average examination time, so only statutory periods and service-charter commitments are listed. If registration is not completed within 1 year of filing for reasons attributable to the applicant, the Director General sets a deadline by notice, after which the application is treated as abandoned.

How to read the periods: "statutory" = set by law; "official statistics" = averages published by the office; "estimate" = typical cases. Actual timing varies.

How much

Official fees

Official fees are in Bangladeshi taka (BDT) and charged per application; since each application covers one class, they are in effect charged per class. They are paid in three stages: the filing fee on filing, the publication fee after examination and the registration fee after the opposition period. The current rates were set by the Ministry of Industries notification of 24 November 2021, effective immediately; the amounts in the DPDT service charter updated in August 2026 match them.

Official fees are as published by the office; the service fee is quoted by an agent after you submit, and you pay only after accepting the quote.

Example: the same mark in Classes 9 and 35 needs two applications: filing fees 2 × BDT 5,000 = BDT 10,000, publication fees 2 × BDT 3,000 = BDT 6,000 and registration fees 2 × BDT 20,000 = BDT 40,000, BDT 56,000 in total.

An official search costs BDT 2,000; renewal is BDT 20,000 per application, and late renewal BDT 25,000 (including a BDT 5,000 late fee). The fee schedule does not say whether VAT is added; the amount payable is the one shown in the A-Challan e-payment system.

Service fees, including the Bangladeshi local agent's fee, are quoted by the agent after you submit the order; you pay only after accepting the quote.

Rules specific to Bangladesh and common refusals

These are the most common issues in Bangladeshi examination, and Bangladesh-specific rules that are easy to overlook.

One class per application

The law requires a separate application for each class of goods or services, examined in order of receipt. A multi-class application filed elsewhere must be split into several applications in Bangladesh, each paying its own filing, publication and registration fees. Settle all the classes you need before filing: a missed class needs a new application with a later filing date.

The first term is only 7 years

Registration dates back to the filing date and first lasts 7 years, then 10 years per renewal. The DPDT service charter asks for renewal at least 3 months before expiry; a mark removed for non-renewal can be restored within 1 year of removal, at a higher fee. If you manage marks in several countries, record the first Bangladeshi expiry date separately.

Priority documents must be filed with the application

To claim priority, file within 6 months of your first application and attach a certified copy of the earlier application, certified by the agent or advocate. The DPDT checklist states that a priority claim without supporting documents gets no filing date or application number, so obtain the copy of your earlier application before filing.

Foreign-language marks need transliteration and translation; no ® on the representation

If the mark contains words in a language other than Bengali or English, such as Chinese, provide a transliteration and translation of each word and state the language. The label filed must not show ® or the logos of bodies such as BSTI or ISO, and a photograph of another person needs their consent.

Bad faith and well-known marks

Applications made in bad faith are refused; a mark identical or confusingly similar to, or a translation of, a mark well known in Bangladesh cannot be registered for identical or similar goods. If you find a pre-emptive filing, oppose within 2 months of publication; once it is registered, you can apply to the Director General or the High Court Division to rectify the register.

Similarity to earlier marks and 5 years of non-use

A mark identical or similar to someone else's registered mark for the same goods is refused, unless there is honest concurrent use. After registration, 5 continuous years without bona fide use allows any interested person to seek removal. A search before filing, and keeping evidence of use after registration, help you avoid both risks.

A mark removed for non-payment of the renewal fee is still treated as on the register for 1 year after removal and can block similar applications by others.

Other IP rights

Patents: the Bangladesh Patent Act, 2023 has been in force since 27 February 2025; invention patents last 20 years from the filing or priority date, with annual fees. Bangladesh is not a PCT member, so applications must be filed directly.

Industrial designs: under the Bangladesh Industrial Design Act, 2023, registration lasts 10 years from the filing or priority date and can be renewed for 5 years at a time, up to 3 times; Bangladesh is not a member of the Hague Agreement, so applications are filed directly with the DPDT.
