To be a service, an activity must be primarily for the benefit of someone other than the applicant. TMEP §1301.01(a)(ii). Therefore, operating a wheat farm, for example, for the purpose of growing, harvesting, and selling wheat for further manufacture, is not a considered wheat farming service under the Trademark Act because, although the manufacturers derive an incidental benefit, the farming activities primarily benefit the farmer. Farming activities must be rendered for others to be considered a service within the meaning of the Trademark Act.
