05-08-2014: Photography services is classified in Class 41. Therefore, providing non-downloadable photographs are classified in Class 41, regardless of the subject matter of the photographs. However, USPTO policy requires specification of the subject matter of the photographs. Services involving leasing the reproduction rights to photographs of others are classified in Class 45 as legal services. Although prior to 10-29-2015, USPTO policy required specification of the subject matter of the photographs, the subject matter is no longer required. Providing a website featuring non-downloadable photographs is acceptable wording; further specification is acceptable but is not required.
