Official English notes
On 05-30-2013, the 06-01-2001 entry was amended to add the words "services" and "live" to clarify the nature of the services and to avoid confusion. For entertainment services in the nature of performances, such as those rendered by a musical group, the performance must be live. Recorded entertainment usually takes the form of goods in Class 9, such as videotapes, audio cassettes, DVDs, CD-ROMs, etc. TMEP §1402.11(g). On 10-2-2014, the 05-30-2013 entry, "Entertainment services in the nature of live visual and audio performances, and musical, variety, news and comedy shows" was modified by replacing "and musical," with "namely, musical," to make clear the nature of the "live visual and audio performances" consistent with current USPTO's specificity requirements for such services.
