Official English notes
On 03-14-2013, this 06-25-2009 entry: "Sports equipment for boxing and martial arts, namely, protective headgear" was amended to "Sports equipment for boxing and martial arts, namely, protective helmets," to avoid confusion and make clear the rationale for classification in Class 9. Protective helmets are classified in Class 9 because helmets function to protect the user's head from life threatening injury, and "Helmets (Protective) for sports" appear in the Nice Alphabetical List in Class 9. Please note that sporting articles, such as "head guards," are classified in Class 28 because of their primary function as sports padding against non-life-threatening injury by dispersing impact, similar to "Elbow guards [sports articles]" and "Knee guards [sports articles]," which appear in the Nice Alphabetical List in Class 28. 01-01-2016: "Head guards for sports" and "Mouth guards for sports" were added to the Nice Alphabetical List in Class 9 under the Nice Classification, Tenth edition, version 2016, effective 01-01-2016. Under Nice 10-2016, mouth guards for sports and head guards for sports are classified in Class 9 because they protect against serious injury and are analogous to the wording "life-saving apparatus and instruments" in the Class 9 Heading.
