On 01-01-2024, this 01-11-2018 entry was deleted because the nature of the goods is unclear under Nice 12-2024. This wording is no longer acceptable. "Herbal extracts, other than essential oils, sold as an integral component of cosmetics" are in Class 3. See also "Skin and body topical lotions, creams and oils for cosmetic use" in Class 3. On 01-01-2026, the status of this 01-01-2024 entry was changed from "D" deleted to "M" Modified. Please note that "Herbal extracts, other than essential oils, sold as an integral component of cosmetics" is no longer acceptable. TMEP §1402.05(a) requires that identification must precisely set forth the common name of the component or ingredient. "Herbal extracts, other than essential oils" does not meet that requirement. Additionally, under Nice 13-2026, essential oils are classified by function or purpose. Therefore, "other than essential oils" is no longer required to justify classification in classes other than Class 3.
