1-1-2012 This entry was added pursuant to the 10th Edition of the Nice Agreement. When listed by itself, an identification for "marketing" should include the term "services." This entry refers to the promoting of the goods and services of others. Prior to January 1, 2012, the USPTO considered "marketing" indefinite because it could encompass promotional services and could also reasonably refer to a retail-type activity. While a retail-type service would also be classified in Class 35, the nature and purpose of a retail-type marketing service is so different from a promotion or advertising-type marketing service that "marketing" was not previously definite. Effective January 1, 2012, "marketing services" is acceptable. "
