12-17-09 - "being part of athletic garments" was added to the 1/15/09 entry to avoid confusion with compression sleeves that are not part of clothing and would be considered sports equipment in Class 28. On 01-01-2015, this 12-17-2009 entry for "clothing for athletic use, namely, padded elbow compression sleeves being part of an athletic garment" was modified to the current entry for clarity and to make clear the rationale for classification in Class 25. Compression articles sold as component parts of finished goods are classified in the same class as the finished good. TMEP §1402.05(a). Note that under NCL 10-2015, "compression garments" was added to Class 10 of the Nice Alphabetical List, and thus, are classified in Class 10 whether for medical or non-medical use.
