Under the Tenth Edition of the Nice Agreement, descriptions of dietetic foods in Class 5 must either specify that they are adapted for medical use or otherwise make clear that the food is for the treatment of a medical condition. The nature of the food (e.g., bread, crackers, etc.) must also be specified in the identification. 01-01-2017 - Effective 01-01-2017, dietetic foods adapted for medical use is acceptable wording; specification of the particular dietetic food items is acceptable, but it is not required.
