02-08-2018 - SMART TOY is a registered mark on the Supplemental Register, see U.S. Reg. No. 4196164, and cannot be used in the identification of goods. See TMEP §1402.09. 03-30-2023 - On 03-03-2023, Reg. No. 4196164 was cancelled. However, "smart toys" alone is an indefinite term and requires further specification as to the nature of the toys which feature smart technology. See for example, "Smart plush toys," "Smart robot toys," and "Smart electronic toy vehicles" in Class 28.
