08-14-2014 - Divot repair tools are classified in Class 28 as sports equipment. Although hand tools are generally classified in Class 8, divot repair tools are classified as sports equipment because they are for use by the players in the course of playing the sport of golf. 01-01-2017 - Under Nice 11-2017, sports-related equipment, i.e., goods used in connection with a sport or game that are not integral to the activity, are classified based on the primary function of the goods. For example, effective January 1, 2017, dart point sharpeners are classified in Class 8 and chess timers are classified in Class 9. Golf divot repair tools are an exception to this general rule and appear in the Nice Alphabetical List in Class 28.
