The word “appliques” is used in the U.S. marketplace to refer to a variety of goods in multiple classes. However, effective January 1, 2013, the wording “Appliques [haberdashery]” appears in the Nice Alphabetical List in Class 26, and this new Alphabetical List entry encompasses clothing decorations such as fabric patches. Therefore, applicants who intend to apply for an Extension of Protection under the Madrid Protocol should consider limiting their use of the term “appliques” to Class 26 because including this term in other classes may result in a Notice of Irregularity.
